Unless otherwise expressly stated, the following words and terms shall, for the purpose of this chapter, have the meanings shown in this section:
ALARM SYSTEM
Either a burglar alarm system as defined in § 98-7 or a fire alarm system as defined in § 98-2.
AUTOMATIC TELEPHONE DIALING SERVICE or DIGITAL ALARM COMMUNICATOR SYSTEM
An alarm system which automatically sends a prerecorded voice message or coded signal over regular telephone lines by direct connection, by other means or otherwise indicating the existence of the emergency situation that the alarm system is designed to detect.
CALENDAR YEAR
Shall consist of twelve (12) months from the activation date of each individual alarm system.
FEE
The assessment of a monetary charge, payable to the City of Butler, authorized pursuant to this chapter, to defray the expense of responding to a false alarm or alarm malfunction.
FIRE PROTECTION SYSTEM
A fire alarm system, as defined in § 98-2.
NONREQUIRED OPERATIVE ALARM SYSTEM
An operative alarm system not required by any entity shall be subject to special requirements as deemed necessary by the Enforcement Official or as recommended by the manufacturer to prevent the creation of an unsafe or hazardous condition.
OWNER
Any person who alone, jointly or severally with others shall have legal title to any building, structure or premises with or without accompanying actual possession thereof and shall include the duly authorized agent or attorney, a purchaser, devise a fiduciary and any person having vested or contingent interest in the property. Also, any person who leases, operates, occupies or manages the property.
PREMISES
Any building, structure, combination of buildings and structures, a piece of land with buildings or structures, wherein an alarm system is installed.
REQUIRED OPERATIVE ALARM SYSTEM/OPERATIVE ALARM SYSTEM
An alarm system which the owner of a premises is required to maintain in an operative condition pursuant to statute, law, ordinance, rule or regulation of any governmental entity.
SERVE
Hand-delivery by an Enforcement Official or his designee to the owner or authorized agent/representative who responded to the premises. In the event that the owner or authorized agent/representative fails to respond to the premises within thirty (30) minutes, "serve" shall mean placing the form or other matter in the United States Mail, postage prepaid, addressed to the owner or authorized representatives.
