It shall not be lawful for any person to lay down or erect any covering over the ditches and drains on any public street, lane or alley in the city unless said ditch or drain be paved with stone the entire length proposed to be covered over, subject to the approval of the City Council, and persons having ditches or drains already covered or bridged shall take the same up and comply with the provisions of this chapter upon twenty (20) days' notice from the City Council, and all persons offending against the provisions of this chapter shall be liable to the penalty of the costs of removing such bridge by the street commissioner and with the additional penalty of twenty percent (20%) upon said costs.
