[HISTORY: Adopted by the City Council of the City of Glen Cove 8-25-1981 by L.L. No. 1-1981 as Ch. 42 of the 1981 Code. Amendments noted where applicable.]
There is hereby established in the City of Glen Cove a Harbor and Waterfront Development and Conservation Commission.
Said Commission shall consist of seven members who shall be appointed by the Mayor and ratified by the City Council of City of Glen Cove. The members of such Commission shall serve for a term of three years. The initial Commission shall consist of two members who shall be appointed for terms of one year; two members to be appointed for terms of two years and three members shall be appointed for terms of three years each. The Chair of said Commission shall be appointed from the membership by the Mayor and such office shall be ratified by the City Council of the City of Glen Cove. No member shall serve more than two consecutive three-year terms.
The Harbor Master shall be an ex officio member of the Commission without a vote.
A. 
The Commission's duties shall be:
(1) 
To examine all proposals having bearing and reflecting upon the use, development or conservation of the harbor, waterways and coastal zone in the city and to make such recommendations to the City Council and/or Planning Board, as the case may be, as shall be deemed to be in the best interests of the City of Glen Cove.
(2) 
To consult with and advise the City Council and Planning Board and/or other appropriate local bodies on all matters relating to the harbor, waterways and coastal zone area within the city's jurisdiction, including but not limited to:
(a) 
Operation of watercraft.
(b) 
Construction of marine structures and dredging.
(c) 
Mooring of vessels.
(d) 
Water pollution.
(e) 
Ecology.
(f) 
Recreational activities.
(3) 
To recommend to the Planning Board and City Council long range planning policies and plans relating to the harbor, waterways and waterfront area. This shall take the form of a Local Waterfront Revitalization Plan, including revisions thereof, prepared as part of the New York State Coastal Zone Management Program.
(4) 
To recommend to the City Council adoption or amendment of ordinances and the taking of other official or unofficial action relating to the harbor, waterways and coastal zone.
(5) 
In the cases of all applications made by any person to the United States Army Corps of Engineers or the New York State Department of Environmental Conservation or the City of Glen Cove Building Department, to recommend to the City Council support or opposition to such applications and, upon authorization, to present statements and take other action on behalf of the city in supporting or opposing such application.
(6) 
To consult and advise with the Chief of Police and Harbor Master on matters relating to the police patrol of the harbor and waterways.
(7) 
To make recommendations to the Board of Appeals and the Planning Board on matters relating to the harbor, waterways and coastal zone.
(8) 
To maintain liaison with appropriate federal, state and county officials on matters relating to the harbor, waterways and coastal zone.
(9) 
To submit to the City Council an annual report of the Commission's activities.
B. 
The Commission shall initiate all such proposals as may be consistent with these purposes and duties.
The Commission shall be responsible for the maintaining of records, which records shall include minutes of its meetings, recommendations, plans and proposals and such records shall become the property of and be part of the records of the City of Glen Cove and as such shall be deemed to be public records.
The Commission may hold public hearings and upon such hearing shall make such recommendations to the City Council and/or Planning Board as it may deem proper and necessary and which shall be predicated upon such findings and determinations after such public hearing.
The Commission, in conjunction with the Harbor Master, shall adopt procedures and forms for carrying out their functions.
