Pursuant to § 27 of the General City Law and § 2-5
of the City Charter, the City Planning Board is continued to consist of seven
members to be appointed by the Mayor with the consent of the City Council,
exclusive of the Mayor, and to serve for three-year staggered terms so that
two expire one year, two expire the following year and three expire the next
succeeding year. If a vacancy occurs other than by expiration of term, it
shall be filled by appointment for the unexpired term.
The Planning Board shall have all the powers and duties that may be
conferred upon it pursuant to Article 3 of the General City Law, including
but not limited to:
A.
Approval of plats. Approval of plats showing lots, blocks
or sites, with or without streets or highways.
B.
Approval of the development of plats. Approval of the
development of plats, entirely or partially undeveloped and which have been
filed in the office of the County Clerk in which such plat is located prior
to the appointment of such Planning Board, and to grant to such Board the
power to approve plats.
The City Clerk shall have the duty to file with the Clerk of Nassau
County a certificate showing that said Planning Board has been so authorized
and that the City Clerk shall issue in its behalf the certificate of failure
to take action as stated in § 32 of the General City Law.
A.
No plan, plat or description showing the layout of any
highway or street upon private property or of building lots in connection
with or in relation to such highway or street shall, within the limits of
the city, be received for recording in the office of the Clerk of Nassau County
unless a copy of such plan, plot or description has been submitted to the
City Planning Board and it has certified with relation thereto its approval
thereof. Such certificate shall be recorded as a part of the record of said
original instrument containing said plan, plot or description. If the Planning
Board fails to act within 45 days of submission of the plat for approval,
the plat shall be deemed to have been approved, and the City Clerk upon demand
shall issue a certificate of failure to take action, which shall be sufficient
in lieu of endorsement for filing such plat in the office of the County Clerk.
B.
No such street or highway which has not received the
approval of the City Planning Board shall be accepted by the city until the
matter has been referred to the City Planning Board.
