No person shall skin dive with any type of diving
equipment within any channel, fairway or legally designated anchorage
or mooring area in the city, nor shall any person bathe, swim or skin
dive in any such areas, except in the course of a rescue or while
performing nonchemical removal of algae during normal boat maintenance,
with proper precautions.
No person shall skin dive with any type of diving
equipment unless he or she has marked the diving area with the regulation
diving flag, nor shall any person allow or permit such diving flag
to remain in any area unless such person is actually skin diving in
the area at the time. No boat shall operate within 50 feet of any
area marked for skin diving by the placement of said regulation diving
flag.
No person shall spearfish with any type of diving
equipment such as scuba (self-contained underwater breathing apparatus,
e.g., Aqua lung, Scott Pak, etc.) nor shall any person use free spears,
CO2 guns or power heads.
No person shall carry loaded apparatus designed
for use in spearfishing nor shall any person load apparatus designed
for use in spearfishing except while in the water at designated spearfishing
areas properly marked for diving with the regulation red diving flag.
Nothing herein contained shall prohibit the
City Council from issuing special permits for aquatic events or salvage
operations under proper supervision in limited areas and for limited
periods of time.
No person shall fish with any type of equipment
from or on the Bridge connecting Dana's Island Highway with East Island
(Morgan's Island).
The provisions of this article shall be enforced
by the Harbormaster, his or her Deputies, or any police officer or
peace officer when operating pursuant to their special duties or by
any other duly appointed law enforcement officer of the City of Glen
Cove.
