This chapter shall be known and may be cited as the "City of Glen Cove Building Enforcement Ordinance."

The purpose of this chapter is to provide for the enforcement procedures in the City of Glen Cove of the New York State Uniform Fire Prevention and Building Code and related building regulations.

The Building Department under the Building Department Administrator shall be responsible for the enforcement of this chapter and the New York State Uniform Fire Prevention and Building Code. The “New York State Uniform Fire Prevention and Building Code” shall mean the construction codes of the State of New York, individually and collectively, as amended, effective January 1, 2003, and shall expressly include:
A. 
Residential Code of New York State.
B. 
Building Code of New York State.
C. 
Fire Code of New York State.
D. 
Energy Conservation Construction Code of New York State.
E. 
Plumbing Code of New York State.
F. 
Property Maintenance Code of New York State.
G. 
Fuel Gas Code of New York State.
H. 
Mechanical Code of New York State.
No officer or employee of the Building Department shall engage in any activity inconsistent with his or her duties or with the interests of the Building Department; nor shall he or she, during the term of his or her office or employment, be engaged directly or indirectly in any building business, in the furnishing of labor, materials or appliances for the construction, alteration or maintenance of a building or the preparation of plans or specifications thereof with the City of Glen Cove, except that this provision shall not prohibit any officer or employee from such activities in connection with the construction of a building or structure owned by him or her and not constructed for sale.
The duties and powers of the Building Department Administrator are as follows:
A. 
Enforce code and laws. Except as otherwise specifically provided by law, this Code, rule or regulation, or except as herein otherwise provided, the Building Department Administrator shall administer and enforce all of the provisions of the New York State Uniform Fire Prevention and Building Code, this Code and laws and regulations applicable to the construction, alteration, repair, removal and demolition of buildings and structures, and the installation and use of materials and equipment therein, and the location, use, occupancy and maintenance thereof.
B. 
Applications and permits. He or she shall receive applications and issue permits for the erection, alteration, removal and demolition of buildings or structures or parts thereof and shall examine the premises for which such applications have been received or such permits have been issued for the purpose of ensuring compliance with the New York State Uniform Fire Prevention and Building Code, this Code and laws, rules and regulations governing building construction.
C. 
Notices and orders. He or she shall issue all appropriate notices or orders to remove illegal or unsafe conditions, to require the necessary safeguards during construction and to ensure compliance during the entire course of construction with the requirements of the New York State Uniform Fire Prevention and Building Code, this Code and applicable rules and regulations. He or she shall make all inspections which are necessary or proper for the carrying out of his or her duties, except that he or she may accept written reports of inspection from the Deputy Building Inspector or other employees of the Building Department or from generally recognized and authoritative service and inspection bureaus, provided that the same are certified by a responsible official thereof.
D. 
Compliance with New York State Uniform Fire Prevention and Building Code. Whenever the same may be necessary or appropriate to assure compliance with the provisions of the New York State Uniform Fire Prevention and Building Code, this Code or applicable laws, rules or regulations covering building construction, he or she may require the performance of tests in the field by experienced, professional persons or by accredited and authoritative testing laboratories or service bureaus or agencies.
E. 
Should the Building Department Administrator deem it necessary, building plans may be referred to and engineer, technical or environmental consultants for review and compliance with the New York State Uniform Fire Prevention and Building Code. The charges made by such consultants shall be paid by the applicant and shall be in accord with charges usually made for such services in the metropolitan New York region or pursuant to an existing contractual agreement between the city and such consultants. The City Council shall approve all such charges before they are incurred. All such charges shall be paid upon submission of a city voucher. Such fee shall be payable prior to final approval by the Building Department Administrator.

A. 
Keeping of permanent records. The Building Department Administrator shall keep permanent official records on all transactions and activities conducted by him or her, including all applications received, permits and certificates issued, fees charged and collected, inspection reports and notices and orders issued. All such records shall be public records open to public inspection during business hours.
B. 
Submission of report to Mayor. The Building Department Administrator shall monthly submit to the Mayor a written report and summary of all business conducted by the Building Department Administrator, including permits and certificates issued, fees collected, orders and notices promulgated, inspections and tests made and appeals or litigation pending or concluded.
The Building Department Administrator shall, with the consent and approval of the City Council, establish, amend, supplement and repeal rules and regulations in conformity with this chapter.
The fire limits of the city are hereby established as indicated on the map, entitled "Fire Limit Map," on file in the office of the Building Department Administrator.
