A. 
Any person who shall violate any of the provisions of this chapter, or who fails to comply with any of the requirements thereof or who fails to comply with any notice of violation issued pursuant to the provisions of Article III, shall be guilty of a violation and, upon conviction, shall be punishable by a fine of not less than $1,000 nor more than $2,000 or by imprisonment for a term not exceeding 15 days, and each day such violation shall be permitted to exist shall constitute a separate offense and shall be punishable therefor as provided herein.
B. 
It is the intent of this chapter that the owner or occupant of any property, whether or not located in the City of Glen Cove, whose use or enjoyment of such property is disturbed or otherwise abridged by a violation of any provision of this chapter, whether or not prosecuted by the City of Glen Cove, shall have the right to bring a civil action for damages, injunction or declaratory relief in any court of competent jurisdiction against any person who violates the provisions of this chapter. To the extent allowed by law, any owner or occupant who shall prevail in such a civil action shall be entitled to recover damages and costs, including reasonable attorneys' fees, and for such other relief as may be determined by a court of law.
C. 
It shall not be a defense to a violation of Article III of this chapter that the receiving property, as defined, is not located within the boundaries of the City of Glen Cove.
