Defined. The threat, with apparent ability to carry it out, to do bodily harm to a person by another.
B.
Penalties.
(1)
First offense: fine not less than $75 nor more than $500 plus costs or 10 days in jail, or both.
(2)
Second offense: fine not less than $150 nor more than $500 plus costs or 20 days in jail, or both.
(3)
Third offense and succeeding offenses: fine not less than $200 nor more than $500 plus costs or not less than 30 days nor more than six months in jail, or both. Counseling may be ordered at the discretion of the Court in all cases but shall not be ordered in lieu of the above penalties.
