Editor's Note: Section 3 of this bill stated that "This Act does not apply to any state-licensed medical clinic lawfully established and operating prior to April 1, 2002. Any state-licensed medical clinic lawfully established and operating after April 1, 2002, and before the effective date of this Act is exempt, for a period of six months after the effective date, from the requirements of Section 4C-102; on or after that date, all such state-licensed medical clinics, and all clinics established and operating after the effective date of this Act, shall conform to the requirements of this Act." Section 5 of Bill No. 39-2002 provided an effective date of 4-16-2002.
As used in this article, the following terms shall have the meanings indicated:
A. 
A freestanding ambulatory-care facility licensed under Title 19, Subtitle 3B, of the Health-General Article of the Annotated Code of Maryland, except a kidney dialysis center.

B. 
A detoxification facility certified under Title 8, Subtitle 4, of the Health-General Article of the Annotated Code of Maryland; or
C. 
An alcohol abuse and drug abuse treatment program certified under Title 8, Subtitle 4, of the Health-General Article of the Annotated Code of Maryland.
A. 
B.R., B.M., B.L., B.L.R., O.T., OR-1, OR-2 and O-3 Zones.
1. 
Subject to the requirements of Paragraph 2, a state-licensed medical clinic is permitted in the B.R., B.M., B.L., B.L.R., O.T., OR-1, OR-2 and O-3 Zones of the County by special exception.
2. 
In addition to the requirements of Section 502, a state-licensed medical clinic permitted by special exception under Paragraph 1 is subject to the following conditions:
a. 
A state-licensed medical clinic may not be located within 750 feet of any residentially-zoned property line.
b. 
Off-street parking shall be provided in accordance with Section 409. The number of spaces shall be sufficient to accommodate all employees and patients of the clinic, as determined by the Zoning Commissioner based upon information filed with the Department of Health and Mental Hygiene concerning the number of patients served by the clinic on a daily basis.
B. 
M.R., M.L.R., M.L. and M.H. Zones.
1. 
A state-licensed medical clinic is permitted in the M.R., M.L.R., M.L. AND M.H. Zones of the County as a matter of right. Off-street parking shall be provided in accordance with Section 409.
