[HISTORY: Adopted by the Common Council of the City of North Tonawanda 12-19-1927. Amendments noted where applicable.]
That it place the City under and within the provisions of Chapter 690 of the Laws of 1926, entitled: "An Act to Amend the General City Law in Relation to Official Maps and Planning Boards," which act became effective April 30, 1926.
It is the declared policy of this City to immediately prepare, adopt and file an official map, within the authority and meaning of Section 26.[1] To this end, the City Engineer is directed to complete a map of the City, as contemplated by Section 26,[2] and to submit it to the City Planning Commission created by a subsequent portion of this ordinance. The Commission shall give consideration to this map, suggesting in writing necessary or expedient changes therein. The Official Map, as prepared in the first instance by the City Engineer, together with the suggested changes therein, indicated both by map line and written memorandum, shall be submitted to this body for final approval. When so approved it shall be filed in the proper public offices as the first and initial official map of the City for the purposes contemplated by Chapter 690 of the Laws of 1926. The Clerk of the City of North Tonawanda is hereby directed to file in the office of the Clerk of Niagara County an instrument certifying that the City has established an official map and plan, as provided by Section 26.[3]

The City Planning Commission heretofore created in the City by ordinance adopted by the Common Council, November 14, 1921, in accordance with Article 12-A of the General Municipal Law, shall continue. The members thereof to be appointed in accordance with the provisions of said Article 12-A, with the powers and duties as specified for a planning board appointed as provided in Article 3 of the General City Law in addition to the powers and duties as specified in said Article 12-A; and the powers and duties of City planning boards as provided by Article 3 of the General City Law are hereby conferred upon such Planning Commission. The Commission shall exercise the powers and perform the duties vested in it under Chapter 690 except as this Council holds in abeyance certain powers or reserves the right to pass upon certain decisions of the Commission, under the discretionary provisions of Chapter 690.
The Commission is hereby vested with the power to approve plans showing new streets or highways, pursuant to Sections 32, 33 and 34 of said law.[1] In accordance with Section 32,[2] the City Clerk is hereby directed to file with the Clerk of Niagara County an instrument certifying that this Commission has been authorized to approve plans and to exercise the powers in relation to the same provided by Chapter 690, and that the Building Inspector of the City of North Tonawanda, and his successor in office, is the officer of the City, who shall issue in the name of the Commission, a certificate of failure to take action in relation to such plans, within the meaning of Section 32.[3]

The Building Inspector of the City shall be the executive officer of the Commission. He shall issue the permits, certificates and instruments contemplated by the several sections of Chapter 690. He shall retain copies in his office as part of the public records of the City.
The City Clerk shall act as Secretary of the Commission and shall keep a minute of its proceedings.
The Commission shall determine the rules of its procedure. It shall keep a record of its hearings and the testimony and statements of persons relative to proposals pending before it. The stenographer assigned to the Board of Appeals shall act as the stenographer of the Commission.
The office of the Commission shall be located in the room assigned to the Building Inspector in the Department of Public Works.
The City Engineer shall act as the technical advisor of the Commission, and his staff shall prepare the maps, descriptions and records required by it.
The Corporation Counsel shall act as the legal advisor of the Commission.
Following the completion and filing of the Official Map of the City, the Commission shall submit to this Council for consideration during the latter part of 1927, a proposed budget for 1928. In the interval, the routine expenses of this Commission shall be presented on verified voucher to the City Clerk for the approval of this Council.
The members of this Commission shall take and file, with the City Clerk, their oaths of office in the form provided by the City Charter. The members shall serve without compensation but shall be paid for the necessary expenses in the performance of the duties of their office. No administrative or appointive officer of the City required to render services to the Commission under this ordinance, shall receive additional compensation.
The reference to various sections in this ordinance means the particular sections of Chapter 690 of the Laws of 1926, effective April 30, 1926.
