[HISTORY: Adopted by the Board of Commissioners of the Township of Nutley 1-6-1970 by Ord. No. 1711 (Ch. 136 of the 1978 Code). Amendments noted where applicable.]
It shall be unlawful for any person, corporation or group of persons to establish, erect, operate or maintain any helicopter landing area for private or commercial purposes unless a permit is first obtained from the office of the Township Clerk.
For the purposes of this chapter, the following terms shall have the meanings indicated:
APPROVED HELICOPTER LANDING AREA
Any buildings, structures, areas of land, waters or waterways used for the takeoff and landing of helicopters for which a permit has been issued in accordance with this chapter.
HELICOPTER
An aircraft whose support in the air is derived from the reaction of a stream of air driven downward by one or more lifting rotors turning about substantially cervical axes.
A. 
Before any permit is issued under this chapter, there shall be filed in the office of the Township Clerk a letter from each of the following officials certifying that the proposed helicopter landing area will permit the safe ascent and descent of helicopters without danger to persons or to property. Criteria shall be as established by the Division of Aeronautics in the Department of Transportation, State of New Jersey:
(1) 
Municipal Engineer.
(2) 
Building Inspector.
(3) 
Chief of Police.
(4) 
Fire Chief.
B. 
When the above certificates have been accomplished, the Township Clerk shall furnish a written statement to the applicant granting authority for the State of New Jersey to issue the necessary license.
C. 
The applicant, upon presentation of the state license, shall be issued a permit as provided in §§ 404-4 and 404-6 of this chapter.
Any permit issued under this chapter shall be issued for a term of one year. The fee for such permit shall be $100, payable to the Township of Nutley.
Renewal permits shall be processed and issued upon the request of the applicant, subject to the same conditions as required for the original permit.

A limited permit may be issued by the Township Clerk, at a fee of $25, subject to the requirements of § 404-3 of this chapter. Said permit shall allow one landing and one takeoff on a specified day and not be subject to renewal.

Any person or corporation who violates or fails to comply with the provisions of this chapter shall, upon conviction thereof, be liable to a penalty of not more than $500 or imprisonment for a term not exceeding 90 days, or both, for each offense.
