A. 
The Board of Health as presently constituted shall be continued.[1]

B. 
Powers and duties. The Board shall:
(1) 
Have all of the functions, powers and duties of a local board of health under Title 26 of the Revised Statutes.
(2) 
Plan and administer a comprehensive public health program, including, without limitation thereto, environmental sanitation, communicable disease control, child and adult health, health education, laboratory services and other services as may be deemed necessary or desirable for the health of the Township.
(3) 
Make and amend ordinances concerning health and administer and enforce said ordinances.
(4) 
Have a Registrar of Vital Statistics, who shall maintain and administer records of vital statistics, including births, deaths and marriages, in accordance with state law, and receive applications for and issue marriage licenses pursuant to law.
Jurisdiction of the animal control program presently in operation in the Township, including supervision of the activities of the Animal Control Officer, maintenance of the animal shelter and equipment and enforcement of the provisions of the ordinances of the Township relating to animals running at large and their licensing, is hereby vested in the Board of Health.

The Board may, subject to the direction and supervision of the Administrator and within available appropriations, appoint such personnel as it may deem necessary, including but not limited to one or more Sanitarians, a Health Officer, Sanitary Engineer, Plumbing Inspector, Animal Control Officer, Registrar of Vital Statistics, public nurses and clerical workers. They shall have the duties and shall receive such compensation as may be provided by general law and the ordinances of the Township. Whenever required by law, such employees shall be the holders of proper licenses issued by the State Department of Health and Senior Services. All such appointments shall be for a term of one year expiring on December 31 in the year of their appointment and until their successors are qualified and assume office. The Administrator may appoint any full-time employee of the Board as the head of the Department.

The Township of Montville hereby adopts the provisions of Subdivision 13 of Article 1, Chapter 3, Title 26, of the Revised Statutes of New Jersey and hereby creates a local Board of Health in the Township of Montville, to be composed of seven members appointed by the Township Committee of the Township of Montville.
The term of office of the members of the Board of Health shall be for three years or until their successors are appointed and qualified. In the event that any vacancy shall occur on the local Board of Health, it shall be filled in the same manner as the original appointment was made but for the unexpired portion of the term.
After the passage of this article and the appointment of the members of the Board of Health, all powers and duties of a local board of health under N.J.S.A. 26:3-1 et seq. shall be vested in the said Board of Health hereby created.
