No person shall allow a dog to run at large in or upon any public building, public facility, turfed area, playground or pedestrian walkway of any public school, public park or other public recreation area within the Township except in the Montville Township dog park in designated areas where dogs may run off leash. Dogs on a leash shall be permitted in public parks in all areas except playgrounds. Any person owning, harboring, keeping or in charge of any dog shall be responsible to immediately remove any dog waste in accordance with §
91-23.

For the purposes of this article, "designated areas" shall be
defined as the "Montville Township Dog Park."
A. Rules and regulations.
(1) Use at your own risk. Dog owners are responsible and liable for the
actions and behavior of their dogs at all times. Montville Township
shall not provide supervision during dog park operating hours.
(2) Dog owners must certify that their homeowner's or renter's insurance
has liability coverage.
(3) All dogs must have current rabies, distemper and parvo vaccinations.
All dogs must also have a negative fecal test. It is recommended that
dogs be on a flea and heartworm preventive medication.
(4) Dog owners must not bring a dog that is ill.
(5) All dogs must wear a current valid license tag and a Montville Township
current valid dog park permit tag.
(6) Dog owners must contact the Montville Township Health Department
to apply for a dog park permit.
(7) Dog park passes are not transferable to other dogs.
(8) Limit of two dogs per adult.
(9) Dogs must be accompanied by an adult 18 years or older at all times.

Dogs must be kept on a leash until inside the gated area.
(11)
No puppies younger than six months old are permitted in the
dog park.
(12)
No children under the age of eight are allowed inside the fence;
all children must be accompanied at all times by an adult 18 years
or older.
(13)
Owners are required to clean up after their dog. Waste bags
are provided.
(14)
Dogs must be removed from the park at the first sign of aggression.
Continued display of aggression by any dog may result in revocation
of membership at the discretion of the Township Health Officer.
(15)
Female dogs must be spayed and male dogs neutered.
(16)
All dog bites shall immediately be reported to the Montville
Township Police Department and the Montville Township Health Department.
(17)
No food allowed (except water in plastic bottles). Play items
must be removed when leaving.
(18)
Small dog park is limited to dogs weighing 35 pounds or lighter
and no more than 18 inches in height, measured from the front shoulder.
Large dog park is open to dogs of all sizes.
(19)
The park may be closed for maintenance without prior notice.
(20)
No smoking allowed on the entire grounds of the dog park, including
any areas outside of the park fence and the parking lot. This includes
cigarettes, e-cigarettes, vapor devices, cigars, pipes, and any other
type of smoking material or device.

Hours. Open during daylight hours only.
(22)
Any person who fails to comply with the rules and regulations
contained in this article may receive a summons to court.
(23)
Upon receipt of formal written documentation, any dog that has
bitten or has shown aggressive behavior towards a person or another
dog on the premises of the dog park may, at the discretion of the
Health Officer, have their dog park membership subject to immediate
and permanent revocation. Should membership be revoked, a letter will
be sent to the dog owner advising them of such, and the owner shall
return their dog park tag(s) to the Montville Township Health Department
at their earliest convenience.

A. Dog park passes must be renewed annually and expire on the last day
of March of each year.
B. No refund will be made on any dog park pass before the expiration
of that pass, or any entry fee, due to the death of the dog, removal
from the Township of the dog, or the revocation of membership of the
dog by the Health Officer.
C. Any dog adopted after April 1, 2006, from the Montville Township
Animal Shelter shall receive free membership rights for the life of
the dog, provided the owner provides yearly membership documentation
and received a valid membership tag through the Montville Township
Department of Health.

Any person, firm or corporation violating any of the provisions of this article shall be subject to such penalties as are provided for in Chapter
1, Article
III, General Penalty. Each and every day that a violation of this article is found to exist shall constitute a unique and separate violation of this article.

All ordinances or parts of ordinances inconsistent with this
article are hereby repealed to the extent of such inconsistencies.

If any section, subsection, sentence, clause, phrase or portion
of this article is for any reason deemed invalid or unconstitutional
by any court of competent jurisdiction, such portion shall be deemed
a separate, distinct and independent provision, and such holding shall
not affect the validity of the remaining portions hereof.

This article shall take effect upon final passage in accordance
with law.
