A. 
A development permit shall be obtained before construction or development begins within any area of special flood hazard established in § 200-4. For the purpose of this chapter, the application for a development permit in a special flood hazard area shall be considered as a mandatory condition of the site plan and subdivision approval. No site plan or subdivision shall be approved which does not conform to the regulations of this chapter.
B. 
In those cases where, under the New Jersey Municipal Land Use Law,[1] site plan or subdivision approval is within the jurisdiction of the Board of Adjustment, such site plan or subdivision approval shall be conditioned upon the issuance of a development permit for construction in a special flood hazard area by the Township of Montville Planning Board.

C. 
Application for a development permit shall be made on forms furnished by the Planning Board and may include, but not be limited to, 12 copies of a plan, drawn to scale, showing the nature, location, dimensions and elevations of the area in question; existing or proposed structures; fill; storage of materials; drainage facilities; and the location of the foregoing. Specifically, the following information is required:
(1) 
Elevation in relation to mean sea level of the lowest floor, including basement, of all structures.
(2) 
Elevation in relation to mean sea level to which any structure has been floodproofed.
(3) 
Certification by a registered professional engineer or architect that the floodproofing methods for any structure meet the floodproofing criteria in § 200-19.
(4) 
Description of the extent to which any watercourse will be altered or relocated as a result of proposed development.
(5) 
All other information required for site plan or subdivision approval necessary for the proper evaluation of drainage, grading, roads, utilities, parking areas, etc., as they apply to construction in the flood hazard area.
The Planning Board of the Township of Montville is hereby appointed to administer and implement this chapter by granting or denying development permit applications in accordance with its provisions.
