Duties of the Planning Board in the enforcement of this chapter shall include, but not be limited to:
A. 
Review of all applications for a development permit for construction in a special flood hazard area to determine that the permit requirements of this chapter have been satisfied.
B. 
Review of all development permits to determine that all necessary permits have been obtained from those federal, state or local governmental agencies from which prior approval is required, or approve conditionally, based upon receipt of all other required approvals.
C. 
Review of all development permits to determine if the proposed development is located in the area of special flood hazard. If located in the area of special flood hazard, assure that a stream encroachment permit has been obtained from the New Jersey Department of Environmental Protection.
When base flood elevation and floodway data has not been provided in accordance with § 200-4, Basis for establishing areas of special flood hazard, the Montville Township Planning Board shall obtain, review and reasonably utilize any base flood elevation and floodway data available from a federal, state or other source in order to administer § 200-19A, Specific standards, Residential construction, and § 200-19B, Specific standards, Nonresidential construction.
The Planning Board shall:
A. 
Obtain and record the actual elevation in relation to mean sea level of the lowest habitable floor, including basement, of all new or substantially improved structures and whether or not the structure contains a basement.
B. 
For all new or substantially improved floodproofed structures:
(1) 
Verify and record the actual elevation in relation to mean sea level.
(2) 
Maintain the floodproofing certifications required in § 200-9C(3).
C. 
Maintain for public inspection all records pertaining to the provisions of this chapter.
The Planning Board shall:
A. 
Notify the New Jersey Department of Environmental Protection prior to any alteration or relocation of a watercourse and submit evidence of such notification to the Federal Insurance Administration (FIA).
B. 
Require that maintenance is provided by the owner of the property wherein the stream is located within the altered or relocated portion of said watercourse so that the flood-carrying capacity is not diminished.
A. 
All interpretations of the Flood Insurance Rate Map for the purpose of purchasing flood insurance shall be made by the lending institution or the FIA.
B. 
Where no lending institution is involved or where there is an appeal, the Planning Board may, for purposes other than flood insurance, make interpretations where needed as to the exact location of the boundaries of the areas of special flood hazard. The person contesting the location of the boundary shall be given a reasonable opportunity to appeal the interpretation as provided in Article VI.
