A. 
It is unlawful for any person to conduct a sale of warehouse merchandise or other goods at a warehouse location in the Township of Montville without first completing an application and obtaining from the Township Clerk a warehouse sale permit. The fee for a warehouse sale permit shall be as set forth in Chapter 169, Fee Schedule.[1]

B. 
Each permit must be prominently displayed on the warehouse premises throughout the entire period of the sale.
C. 
No permit shall be issued for more than 10 consecutive calendar days.
D. 
Only four permits shall be issued to any one person and/or for any one location within a twelve-month period.
An application must be filed with the Township Clerk at least 30 days prior to the sale date containing the following information:
A. 
Name of the person, firm, group, corporation, association or organization conducting the sale.
B. 
Location at which the sale is to be conducted.
C. 
Number of days of the sale.
D. 
A traffic circulation and parking plan.
E. 
Statement as to how the permittee proposes to provide adequate sanitary facilities and adequate provision for garbage/recycling collection.
F. 
A signage plan.
G. 
Proof of comprehensive general liability insurance in an amount of $1,000,000.
H. 
Sworn statement or affirmation by the person signing that the information given therein is true and known by him or her to be so.
Upon receipt of a completed application, the Township Clerk shall forward a copy of the application to the Police Department, Zoning Officer and Health Department. They shall investigate the application and shall issue a report to the governing body concerning the aspects of the application within their jurisdiction.

The Township Committee shall authorize the issuance of a warehouse sale permit upon finding that the applicant has adequately provided for safe traffic circulation and parking, sanitary facilities, garbage recycling collection, and fire safety and that the sale will not be detrimental to the public health and safety. It is understood that fire safety and any other necessary inspections may be made of the premises after a permit is issued and during the sale.
Temporary signs advertising the warehouse sale shall be permitted only in accordance with a signage plan submitted by the applicant and approved by the issuance of a warehouse sale permit. All signs advertising a warehouse sale must be removed within 48 hours following the last day which the sale is conducted. The applicant shall post a cash bond in the amount of $20 per sign to insure the removal of the signs. The Township shall have the right to remove any signs which remain posted 48 hours after the last sale date, and the applicant shall forfeit the bond posted for each sign removed by the Township.
A. 
Any person violating or failing to comply with any of the provisions of this article shall, upon conviction before the Judge of the Municipal Court of the Township of Montville, be punished as set forth in Chapter 1, Article III, General Penalty. Each day of sale in violation of any or all of the provisions of this article shall be a separate offense.[1]

B. 
This article may be enforced by the Police Department and all other agencies with responsibility for inspections and investigation prior to the issuance of a permit.
