It shall be unlawful for any person, persons,
firm or corporation, whether as principal, agent, servant, employee
or otherwise, to dump any refuse, ashes, garbage, papers, factory
waste, organic or nonorganic matters upon any land, road, street,
alley or lane in the Township of Montville, or to use or permit to
be used any land, road, alley, street or lane in the Township of Montville
as a dumping ground for refuse, ashes, garbage, papers, factory waste,
organic or nonorganic matters, or to establish a dump for the disposal
of refuse, ashes, garbage, papers, factory waste, organic or nonorganic
matters within the Township of Montville, without having first obtained
a permit to do so as herein provided.
Application for such permit shall be made in
writing to the Board of Health of the Township of Montville, and upon
receiving such application the Board of Health shall investigate the
same. If in the opinion of the Board the proposed dumping place can
be maintained in a sanitary manner, then the Board may, in its discretion,
issue a permit therefor, such permit to be limited to the particular
property for which it is to be used and to specify the time in which
it may be used and the regulations under which such dumping may take
place, so that it may be maintained in a sanitary manner and not become
a nuisance and a menace to the health of the community. Every permit
issued hereunder shall expire on June 30 following its issuance unless
renewed on like application.

Any person or corporation who violates any of
the provisions of this chapter, shall, upon conviction, pay a fine
of not less than $2,500 nor more than $10,000 and/or be subject to
a term of imprisonment not exceed 90 days and/or a period of community
service not exceeding 90 days, in the discretion of the court, for
each violation.
