That a certain document, a copy of which is on file in the office of the Borough Clerk of the Borough of South Plainfield, being marked and designated as the International Property Maintenance Code, 2009 edition, as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Borough of South Plainfield, in the State of New Jersey for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the Borough Clerk are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 322-2 of this chapter.
The following sections are hereby revised:
Section 101.1
Insert: "Borough of South Plainfield."
Section 103.5
Insert: "In addition to the actual cost incurred by the department, a $1,000 fee shall be added to any lien placed against real estate to offset the administration cost incurred by the department and the municipality."
Section 106.4
Delete: "shall be prosecuted within the limits provided by state or local laws."
Insert: "upon conviction, a fine of not less than $100 nor more than $2,000 or imprisonment for a term not to exceed 30 days, or both."
Section 112.4
Insert: "Not less than $100 or more than $2,000."
Section 302.4
Insert: "six (6) inches."
Add to end of paragraph: "Hedges, bushes and shrubs shall be kept trimmed in order to prevent any over growth onto any adjacent property."
Section 302.4a
Add: "The owner of any vacant lands fronting on any improved street, or roadway shall be required to keep all grass and weeds growing within 10 feet of any street or roadway cut and trimmed to a height of not more than six inches, and shall be required to keep all bushes and other plant life growing within 10 feet of any street or roadway trimmed."
Section 302.8
Delete: "inoperative or unlicensed."
Insert: "uninsured or uninspected."
Section 304.14

Ordinance No. 1710 of the Borough of South Plainfield entitled “An Ordinance Establishing a Property Maintenance Code for the Borough of South Plainfield, County of Middlesex, State of New Jersey, Prescribing Regulations Therefore Consistent with Nationally Recognized Standards” and all other ordinances or part of ordinances in conflict herein are hereby repealed.
Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 333-3 of this chapter; nor shall any just legal right or remedy of any character be lost, impaired or affected by this chapter.
