As used in this article, the following terms have the meanings indicated:
RECYCLABLES
Discarded materials which may be reclaimed comprising solid waste in the form of newspapers, clear glass bottles and jars, bimetallic cans, plastic, corrugated cardboard boxes and mixed paper which may be further defined as follows:

A. 
(1) 
Newspapers include daily newspapers, Sunday magazines, advertising inserts and mailed advertising sheets on newspaper stock. Newspapers must be dry, clean and tied in twelve-inch stacks.
(2) 
Newspapers do not include magazines, junk mail, file folders, telephone books, advertisements, reports, paperback books and stationery.
B. 
(1) 
Clear glass bottles and jars include only clear glass bottles and jars and may be recycled.
(2) 
Bottles and jars do not include ceramics, window glass, safety glass or colored glass bottles and jars.
C. 
(1) 
Bimetallic cans includes aluminum and tin cans.
(2) 
Bimetallic cans do not include steel or other metal containers, including aerosol cans or cans contaminated with toxic chemicals.
D. 
PLASTICSRecyclable plastics include only those marked PETE (1) and HDPE (2). The PETE and HDPE labels are clearly stamped on each container. Examples of these types of plastics include beverage containers, milk, cider, orange juice and water jugs, liquid detergent and bleach containers.
E. 
CORRUGATED CARDBOARDRecyclable corrugated cardboard boxes, including packing and shipping boxes, that are clean and dry and free of wax or plastic coatings.
F. 
(1) 
Magazines, catalogs, color inserts from newspapers, undeliverable and/or advertising mail, school paper and office paper.
(2) 
All the acceptable material can be mixed together and placed in plastic bags, brown paper bags or cardboard boxes so as to not be blown by wind.
A. 
Recyclables shall be separated from all other garbage or solid waste.
B. 
Recyclables shall be placed at the curbside on the designated morning for collection. Recyclables shall not be placed in such a manner as to become a hazard or potential hazard to public travel, health or safety or to become a nuisance of any sort.
C. 
The recycling bins will be picked up at curbside according to the schedule set by the Village. All recycling bins shall be placed for collection at curbside by 7:00 a.m. on the designated collection day. Emptied recycling bins shall be removed from curbside by 9:00 p.m. of the scheduled day of collection and stored out of public view.

D. 
Newspapers shall be tied with twine in bundles not more than 12 inches high. Newspapers are to be placed beside or on top of the recycling bins.
E. 
Clear glass bottles and jars, bimetallic cans and plastics shall be rinsed and cleaned. Labels need not be removed. Caps and lids must be removed. These recyclables are to be placed inside the recycling bins.
F. 
Corrugated cardboard boxes must be flattened. These may be placed beside the recycling bin.
G. 
Mixed paper shall be placed in bags or boxes and placed beside or in the recycling bins.
H. 
Recyclables shall not be placed in the same garbage can as, or otherwise mixed with, other forms of solid waste for collection, removal or disposal.
I. 
From the time of placement beside the curb, recyclable materials shall become the property of the Village of Monticello. It shall be unlawful for anyone to collect, remove or dispose of recyclables which are the property of the Village without the consent of the Village Board.
J. 
The Village Board shall be permitted, from time to time, to promulgate such rules or regulations as may be deemed necessary to effectuate the intent of this Part 2.
K. 
If the bins are lost or damaged they will be replaced at the property owner's expense. Uncollected bills will become a lien on the property.[1]

A. 
A person convicted of violating the provisions of this Article III shall be guilty of a violation which is punishable as follows:

(1) 
For a first conviction: by a fine of not less than $25 nor more than $50.
(2) 
For a second conviction: by a fine of not less than $50 nor more than $100.
(3) 
For a third or subsequent conviction within one year: by a fine of not less than $100 nor more than $250.
B. 
Failure to comply with the terms of this article on a subsequent recycling or collection day shall be considered a separate offense.
