The owners of buildings adjacent to public streets and sidewalks
shall prevent the falling of snow, ice or water from such buildings
upon such streets or sidewalks.

A. All snow, ice, dirt (not including that applied for purpose of rendering
the ice safe to traverse) or other obstruction upon any public sidewalk
in the Village of Monticello, New York, shall be removed by the owner
promptly after such snow, ice, dirt or other obstruction is deposited
thereon. "Promptly" herein is defined as being within five hours after
the same is deposited thereon, or within one hour after being directed
to do so by any official, police officer or representative of the
Village. In addition, sidewalks as well as stairs or ramps in front
of the landowner's property to the curb must be maintained free
from snow, ice, dirt (not including that applied for purpose of rendering
the ice safe to traverse) or other obstruction from 8:30 a.m. until
6:30 p.m. each day except Sunday, and from 8:30 a.m. to 3:00 p.m.
on Sundays. The public sidewalk is defined as being all that paved
or hard-surfaced space located between the front of any structure
and the public street. Sand or dirt applied for the purpose of rendering
the ice safe to traverse must be removed within 24 hours after the
ice condition for which it was applied has been abated.
B. No salt, sand or registered motorized vehicles or any equipment weighing
over 3,500 pounds may be used on sidewalks, stairs or ramps to remove
snow or ice.
No person or corporation, being the owner or occupant of any
premises abutting on any street, shall throw, place or deposit any
snow or ice onto or upon any street in said Village except such as
falls upon or is formed upon that portion of the property so abutting
said street lying within the sidewalk lines thereof. It is the intent
and purpose of the provisions of this section to prohibit all persons
from throwing, casting, placing or depositing snow and ice which accumulates
within the private property belonging to persons or corporations upon
the sidewalks or streets of the Village of Monticello.

In case such snow or ice shall not be removed from such sidewalks or shall be cast, deposited, thrown or placed upon said sidewalk or said street by the owner or owners, occupant or occupants of any premises as provided in §§
220-24 and
220-25, the same may be removed by and under the direction of the Superintendent of Public Works, and the cost thereof, as nearly as can be ascertained, shall be certified to the Town Assessor whose duty it is to assess and levy taxes for said Village and shall thereupon become and be a first and paramount lien upon said premises and shall be added to, recorded and collected in the same manner as the taxes next to be assessed and levied against such premises. The imposition and collection of the fine or fines imposed by the provisions of this article shall not constitute any bar to the right of the Village of Monticello to collect the costs as certified for the removal of said snow or ice in the manner herein authorized.

Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation, punishable as provided in Article
III, General Penalty, of Chapter
1 of the Code of the Village of Monticello.
