This chapter shall be known as "The Driveway Ordinance of the
Village of Brockport."
The purpose of this chapter shall be to regulate the installation
of driveway entrances in and to Village streets, and the paving of
driveways between Village streets to and across sidewalks.
No new driveway shall be connected to a Village street, nor
may an existing driveway entrance be changed or enlarged, nor may
a Village curb be allowed or removed, without a permit therefor.
Public sidewalks on any street in the Village, or fronting on
any street in the Village or parallel to any street in the Village,
shall continue to be regulated by the Sidewalk Ordinance of the Village
of Brockport, adopted May 4, 1908. A "Village street" shall be defined as any street, road
or highway maintained by the Village, county or state, lying in the
Village of Brockport.
No public sidewalk shall be covered or constructed of any paving
material other than cement or flagstone, and no driveway paved with
other substances shall be extended over such sidewalks so as to cover
the cement or flagstone sidewalk.
Application for permits hereunder shall be made to the Village
Superintendent of Streets, who shall issue said permit after inspection
or review of the site. The Superintendent shall determine the grades
and sizes of driveways and may impose conditions of construction to
ensure compliance with ordinances, stormwater drainage and traffic
safety. If the Superintendent is absent or unavailable, the Village Clerk shall act in his stead.
In the event that any sidewalk is paved in a manner other than
as prescribed by the ordinances of this Village, such sidewalk shall
be deemed in disrepair and the sidewalk may be repaired in accordance
with applicable Village law at the expense of the owner of the adjoining
lands.

Any person who shall violate any provision of this chapter shall
forfeit and pay to the Village of Brockport a penalty not to exceed
$1,000 for each and every offense, to be recovered with costs of suit.
This chapter shall take effect 10 days after publication.
