For the purpose of this article, the following
words and phrases shall have the meanings respectively ascribed to
them by this section:
Large items such as washers, dryers, refrigerators, freezers,
dishwashers, ovens, ranges, hot water heaters, cold water tank, air
conditioners, gas/oil/electric heaters, metal storage cabinets/shelves,
swing sets, bicycles, large auto parts, metal lawn care equipment
and/or any other large appliance commonly referred to as a "white
good," whose size precludes or complicates normal handling.
Large items of solid waste, such as furniture, chemically
treated woods, carpets and other oversize items whose size precludes
or complicates handling by normal collection.
All trash, garbage, bulk trash, bulk appliances/metal, yard/wood
waste and recyclable materials.
Debris that is generated by a contractor or by an occupant
in connection with construction or demolition.
Stones, dirt, demolition material, broken concrete and other
like material.
Any violation of any of the rules or regulations set forth
in this article; provided, however that no violation of any rule or
regulation of this article occurred and was attributed to the same
violator for a period of at least one year immediately preceding the
violation.
Animal or vegetable waste incident to and resulting from
the use, preparation, cooking and consumption of food.
PAPER PRODUCTSAll uncontaminated paper material, such as newspaper, magazines, books, wrapping paper, bags, discarded letters and envelopes, coated magazines, catalogues and similar printed material, soft-covered books and "junk" mail.
GLASSAll products made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for packaging or bottling of various matter and all other material commonly known as "clear (flint)," "green" or "brown (amber)". "Glass" shall not include crystal, ceramics, light bulbs and plate, window, laminated, wired or mirrored glass.
ALUMINUMAll products made of aluminum, commonly known as "metal cans," "tin cans," "bimetal cans," or "ferrous cans." "Bimetal cans" does not include paint, aerosol, oil lighter fluid or other such types of cans.
CORRUGATED CARDBOARDAll uncontaminated double-layered brown cardboard.
PLASTIC BOTTLESPlastic bottles, such as these for milk, soda, water and detergent. These items are identified with a number "1" or a number "2" within the recycling triangle symbol located on the bottom of the plastic bottle.
Any violation of any of the rules or regulations set forth
in this article that occurs within one year of the first offense of
any rule or regulation of this article by the same violator.
Any violation of any of the rules or regulations set forth
in this article that occurs subsequent to a second offense and within
one year of a first offense by the same violator.
Includes but shall not be limited to ashes, rubbish, refuse, yard woodwork, waste materials, rags, crockery, ordinary household refuse, waste food, bulk trash and bulk appliances deposited by residents along the curbline in containers and/or bundles. It shall not include recyclable materials as designated by this section and § 582-8, as amended.
Leaves, trees, branches, stumps, bushes, hedge trimmings,
weeds, pallets and untreated lumber.
All trash and garbage collected within and disposed
of within this municipality shall be disposed of in accordance with
the Solid Waste Management Act, N.J.S.A. 13:1E-1 et seq. No trash
and/or garbage collected or generated outside of Greenwich Township
shall be brought into Greenwich Township for disposal or any other
purpose.
The Township Mayor and Council shall establish
by ordinance or resolution the days and hours for the collection of
rubbish and the areas within the Township of Greenwich to be collected
on the various days of the week. Hours of collection 7:00 a.m. to
3:30 p.m. normally. Trash is normally collected in four separate routes
Monday through Thursday. Any changes to an individual trash route
must be approved by Mayor and Council.
The following rules and regulations must be
observed in the preparation of garbage and trash before placing it
at curbside for collection. These rules and regulations may be changed
or amended by resolution as circumstances may require.
A.
Keep garbage and trash in rear of premises until the
night before the scheduled collection day. Garbage and trash must
be placed curbside by 6:30 a.m. on the scheduled collection day.
B.
Garbage and trash must be placed in suitable containers
or bundles not exceeding 35 gallons' capacity and 50 pounds in weight
when filled.
C.
After collection, any empty containers shall be removed
from the curbside promptly, but no later than 7:00 p.m. of the day
of the collection.
D.
Bulk appliances/metal, as defined above, including
white goods, shall be put curbside the day before this scheduled collection.
Any of the above referenced items with doors must be dismantled. Wheels
and rubbers goods should also be removed when necessary.
E.
No collections will be made of barrels, manure, construction
debris, or other debris, as defined in this article, including but
not limited to earth, plaster, cement, brick, lumber, stones, dirt,
broken concrete.
F.
Property owners must provide sufficient containers
for their needs. The owner, tenant and/or occupant shall maintain
the receptacles and area for the location of such materials as described
herein in a clean and safe condition for handling and for purposes
of collection and/or recovery.
G.
Garbage and trash is not to be put out for collection
in paper bags or cardboard boxes as same tends to break and promote
litter.
H.
All garbage shall be drained and securely wrapped
and tied in suitable material such as plastic bags and placed in or
alongside trash containers.
I.
All persons, firms or corporations setting out or
causing to be set out any garbage, or trash, shall securely bundle
the same to prevent any part thereof from being blown or scattered
about.
J.
Only Greenwich Township employees in the performance
of their collection duties or persons specifically authorized by Township
of Greenwich may collect trash or garbage after it has been placed
at the curbline for collection.
K.
All collected materials as defined above shall be
placed between the curb and sidewalk, accessible to the collector
and shall be placed so as not to block the sidewalk or make said sidewalk
hazardous to or unusable by the public.
L.
The collection of bulk trash, as defined above and
including furniture, chemically treated woods and carpets, is limited
to two items per week.
M.
All yard/wood waste, as defined above, including tree
clippings, brush, stumps and the like, which are generated by a private
contractor shall be disposed of by the contractor by private means.
N.
The litter receptacles located in the downtown area,
parks and playgrounds which are for pedestrian-generated litter, are
not to be used for disposing of household or commercially generated
garbage or trash.
O.
Materials generated from minor home repairs and cleanups
that do not require a permit may be placed at curbside for collection.
Loose boards, wood products and other like materials are to bundled
and tied in lengths no to exceed four feet in length and not to exceed
50 pounds in weight or properly contained.
P.
Discarded items with concrete attached, such as pipes
and posts, shall have the concrete broken off and the item shall be
placed at curbside for collection.
Q.
Rolled goods, such as carpets, carpet padding, pool
liners, fencing and the like, must be rolled in bundles and tied and
must not be longer than four feet in length and 50 pounds in weight.
R.
Tree trimmings and brush are to be placed at curbside
for chipping on the day designated herein for chipping. All roots
and dirt must be removed in order to be chipped.
S.
All glass components of doors and windows must be
broken out of their frames and put into proper containers for trash
collection. This glass is not to be recycled.
T.
Cleanup of leaves, grass, vines, roots and shrubs
(other than during the spring and autumn leaf collection program)
should be put in trash cans or bagged for collection on the regular
aforementioned trash days. Leaves are not to be raked into the gutter
except during the autumn leaf collection.
U.
Only two tires per week will be collected. Businesses
that generated used tires through business operations must dispose
of them through a licensed recycling service.
V.
Construction debris generated by a contractor or property
owner will not be removed by the Township. Disposal is the responsibility
of the property owner or contractor doing the work. This includes
concrete, blocks, bricks and stone.
No trash, garbage, vegetable or animal waste,
construction debris or any other solid waste collected or generated
outside of Greenwich Township shall be brought into Greenwich Township
for collection and/or disposal. Any person or any owner, tenant, lessee
or occupant of any residential, commercial or industrial building
within Greenwich Township who brings such trash, garbage, vegetable
or animal waste, construction debris or any other solid waste generated
outside of Greenwich Township into Greenwich Township for collection
and/or disposal shall be in violation of this article and shall be subject to the penalties
established herein.
It shall be the responsibility of the Director
of Public Works and/or the Construction Officer and/or the Police
Department and their designated agents to enforce all provisions of
this article.
A.
Any person, firm or corporation that violates or neglects
to comply with any provision of this article or any regulation promulgated
pursuant hereto, or any provisions or regulation hereinafter enacted
as an amendment or supplemental to this article shall receive a written
warning for the first offense.
B.
Any person, firm or corporation that violates or neglects
to comply with any provision of this article or any regulation promulgated
pursuant hereto, or any provisions or regulation hereinafter enacted
as an amendment or supplemental to this article, who has received
a written warning, shall upon conviction be subject to a fine at an
amount not exceeding $2,500 or a maximum penalty by a fine not exceeding
$10,000.

SOURCE SEPARATION
For the purpose of this article, the following words
shall have the meanings respectively ascribed to them by this section.
A combining of nonputrescible source-separated recyclable
materials for the purpose of recycling (i.e., placed in the same container).
Those materials designated within the Gloucester County District
Solid Waste Management Plan to be source-separated for the purpose
of recycling. These materials include: glass, paper, plastic containers,
aluminum and ferrous cans, food waste, corrugated and other cardboard,
newspaper, magazines or high-grade office paper.
Any building or structure, or complex of buildings in which
three or more dwelling units are owner-occupied or rented or leased,
or offered for rental or lease, for residential purposes (see N.J.S.A.
13:1E-99.13a.) and shall include hotels, motels, or other guest houses
serving transient or seasonal guests as those terms are defined under
Subsection (j) of Section 3 of the "Hotel and Multiple Dwelling Law,"
P.L. 1967, c. 76 (N.J.S.A. 55:13A-1 et seq.).
The person or persons appointed by the municipal governing
body and who shall be authorized to, among other things, enforce the
provisions of this article, and any rules and regulations which may
be promulgated hereunder.
All solid waste generated at residential, commercial, and
institutional establishments within the boundaries of Greenwich Township.
Those materials, which would otherwise become solid waste,
and which may be collected, separated, or processed and returned to
the economic mainstream in the form of raw materials or products.
Recyclable materials, which are separated at the point of
generation by the generator thereof from solid waste for the purposes
of recycling.
The process by which recyclable materials are separated at
the point of generation by the generator thereof from solid waste
for the purposes of recycling.
B.
All other terms and phrases shall be as defined in
the New Jersey Solid Waste Management Act (SWMA), the regulations
promulgated under the SWMA, and the Gloucester County Solid Waste
Management Plan, unless context clearly requires a different meaning.
A.
Mandatory source separation. It shall be mandatory
for all persons who are owners, tenants, or occupants of residential
and nonresidential premises, which shall include but not be limited
to retail and other commercial locations, as well as government, schools
and other institutional locations within Greenwich Township, to separate
designated recyclable materials from all solid waste. Designated recyclable
materials shall be deposited separate and apart from other solid waste
generated by the owners, tenants, or occupants of such premises and
shall be placed separately at the curb in a manner and on such days
and times as may be advertised by the Township and county.
B.
Exemptions. Pursuant to N.J.S.A. 13:1E-99.16(d), Greenwich
Township may exempt persons occupying commercial or institutional
premises within its municipal boundaries from the source separation
requirements if those persons have otherwise provided for the recycling
of all designated recyclable materials. To be eligible for an exemption,
a commercial or institutional generator of solid waste shall file
an application for exemption with the municipal recycling coordinator
on forms to be provided for this purpose. The form shall include,
at a minimum, the following information: the name of the commercial
or institutional entity; the street address location and lot and block
designation; the name, official title and phone number of the person
making application on behalf of the commercial or institutional entity;
the name, address, official contact person and telephone number of
the facility which provides the service of recycling those designated
recyclable materials, and a certification that the designated recyclable
materials will be recycled, and that, at least on an annual basis,
said recycling service provider or commercial/institutional generator
shall provide written documentation to the municipal recycling coordinator
of the total number of tons collected and recycled for each designated
material.
The collection of recyclable material shall
be in the manner prescribed as follows:
A.
All recyclables placed at the roadside by residents
for collection shall be prepared for collection in accordance with
the following:
(1)
All newspapers shall be placed in paper bags or tied
with bundles not exceeding 35 pounds in weight nor exceeding one foot
in thickness.
(2)
Cardboard shall be flattened and tied in bundles with
dimensions not exceeding one feet by three feet by three feet.
(3)
Glass containers shall have caps and lids removed.
(4)
Glass and cans shall be rinsed free of contaminants.
(5)
Glass and cans shall be placed in separate containers.
Plastic and/or paper garbage shall not be utilized as container for
glass and cans.
(6)
The owner or occupant of the premises shall keep all
receptacles clean and in a safe handling condition.
B.
No material shall be placed at the roadside earlier
than the evening of the day preceding a scheduled collection day.
Material must be placed at the roadside by 6:00 a.m. on the scheduled
collection day. The bundled paper, bundled cardboard and the containers
of glass and cans shall be placed at the roadside for collection adjacent
to one another and clearly separated from containers of solid waste.
After collection, any containers shall be removed from the curbside
by no later than 7:00 p.m. of the day of collection.
A.
No person shall dispose of leaves, arrange for the
disposal of leaves or cause leaves to be disposed of except as provided
herein.
B.
All persons occupying residential premises and who
are served by a municipal program for separate collection of leaves
shall source-separate all leaves during the period from September
1 through December 31, inclusive, and place them for collection at
the times and in the manner heretofore or hereafter prescribed by
Greenwich Township.
C.
All persons occupying residential premises and who
are not served by a municipal program for separate collection of leaves
shall arrange for the separate disposal or processing of leaves at
a composting facility or an agricultural, horticultural, silvicultural
or other commercial operation which processes or utilizes leaves for
compost, mulch or other beneficial uses.
D.
All other persons shall dispose of leaves, arrange
for the disposal of leaves or cause leaves to be disposed of in accordance
with state, county and municipal regulations.
E.
Nothing herein shall require any person to gather
leaves or prevent any person from utilizing leaves for compost, mulch
or other agricultural, horticultural, silvicultural, gardening or
landscaping purposes.
F.
Brush shall be placed at curbside.
The owner of any property shall be responsible
for compliance with this article. For multifamily units, the management
or owner is responsible for setting up and maintaining the recycling
system, including collection of recyclable materials, in accordance
with guidelines or regulations established by the appropriate municipal
office. Violations and penalty notices will be directed to the owner
or management in those instances where the violator is not easily
identifiable. The management shall issue notification and collection
rules to new tenants when they arrive and every six months during
their occupancy.
A.
All commercial and institutional generators of solid
waste shall be required to comply with the provisions of this article.
B.
The arrangement for collection of designated recyclables
hereunder shall be the responsibility of the commercial, institutional
or industrial property owner or their designee, unless the municipality
provides for the collection of designated recyclable materials. All
commercial, institutional or industrial properties which provide outdoors
litter receptacles and disposal service shall also provide receptacles
for designated recyclable materials in the location of the litter
receptacle, and shall provide for separate recycling service for their
contents.
C.
Every business, institution, or industrial facility
shall report on an annual basis to the Recycling Coordinator, on such
forms as may be prescribed, on recycling activities at their premises,
including the amount of recycled material, collected and recycled
and the vendor or vendors providing recycling service.
D.
All food service establishments shall, in addition
to compliance with all other recycling requirements, be required to
recycle grease and/or cooking oil created in the processing of food
or food products, and maintain such records as may be prescribed for
inspection by any code enforcement officer.
Pursuant to N.J.S.A. 13:1E-99.13a and 99.16c:
A.
Any application to the Planning Board of Greenwich
Township for subdivision or site plan approval for the construction
of multifamily dwellings of three or more units, single-family developments
of 50 or more units, or any commercial, institutional, or industrial
development for the utilization of 1,000 square feet or more of land,
must include a recycling plan. This plan must contain, at a minimum,
the following:
(1)
A detailed analysis of the expected composition and
amounts of solid waste and recyclables generated at the proposed development;
and
(2)
Locations documented on the applicant's site plan
that provide for convenient recycling opportunities for all owners,
tenants, and occupants. The recycling area shall be of sufficient
size, convenient location and contain other attributes (signage, lighting,
fencing, etc.) as may be determined by the Municipal Recycling Coordinator
with advice from the Board's professionals.
B.
Prior to the issuance of a certificate of occupancy
by Greenwich Township, the owner of any new multifamily housing or
commercial, institutional, or industrial development must supply a
copy of a duly executed contract with a hauling company for the purposes
of collection and recycling of source-separated recyclable materials
in those instances where the municipality does not otherwise provide
this service.
C.
Provision shall be made for the indoor, or enclosed
outdoor, storage and pickup of solid waste, to be approved by the
municipal engineer.
A.
It shall be unlawful for solid waste collectors to
collect solid waste that is mixed with, or contains visible signs
of, designated recyclable materials. It is also unlawful for solid
waste collectors to remove for disposal those bags or containers of
solid waste, which visibly display a warning, notice sticker or some
other device indicating that the load of solid waste contains designated
recyclable materials.
B.
It shall be the responsibility of the resident or
occupant to properly segregate the uncollected solid waste for proper
disposal or recycling. Allowing such unseparated solid waste and recyclables
to accumulate will be considered a violation of this article and the
local sanitary code.
C.
Once placed in the location identified by this article,
or any rules or regulations promulgated pursuant to this article,
no person, other than those authorized by the municipality, shall
tamper with, collect, remove, or otherwise handle designated recyclable
materials.
The Code Enforcement Official, the Department
of Health, the Recycling Coordinator, the Property Maintenance Official,
the Housing Officer, and the Gloucester County Department of Health
are hereby individually and severally empowered to enforce the provisions
of this article. An inspection may consist of sorting through containers
and opening of solid waste bags to detect, by sound or sight, the
presence of any recyclable material.
A.
Any person, corporation, occupant, or entity that
violates or fails to comply with any provision of this article or
any of the rules and regulations promulgated hereunder shall, upon
conviction thereof, be punishable by a fine in an amount not exceeding
$2,500 or a maximum penalty by a fine not exceeding $10,000. Each
day for which a violation of this article occurs shall be considered
a separate offence.[1]
B.
Fines levied and collected pursuant to the provisions
of this article shall be immediately deposited into the Municipal
Recycling Trust Fund (or equivalent). Monies in the Municipal Recycling
Trust Fund shall be used for the expenses of the municipal recycling
program.
