A. 
Notwithstanding the power of the Town Board as licensing authority to revoke, cancel or suspend a license for cause and subject to a hearing, pursuant to Article III hereof, this Chapter 59 shall be enforced by the Town of Wallkill Code Enforcement Officer/Building Inspector, and by the Town of Wallkill Police Chief, and their respective officials, designees, agents and assigns, pursuant to the Town Code of the Town of Wallkill, including, without limitation, Chapter 3 thereof.
B. 
Said Town of Wallkill Code Enforcement Officer/Building Inspector and Police Chief, and their respective officials, designees, agents and assigns, are hereby authorized to issue and serve an appearance ticket with respect to a violation of this chapter.
A. 
Any person, including, without limitation, the owner or licensee of any sexually oriented business regulated under this Chapter 59, who commits or permits any acts in violation of any of the provisions of this Chapter 59, including, without limitation, related sections of the Town of Wallkill Town Code and Zoning Code, shall be deemed to have committed an offense against such chapter and shall also be liable for any such violation or the penalty therefor.
B. 
Each such act in violation, and each day that such violation shall continue or be permitted to exist, shall constitute a separate violation.
C. 
For every violation of any provision of this Chapter 59, the person violating the same shall be subject to a civil penalty enforceable and collectible by the Town of Wallkill in the amount of $1,000 for each such violation.
D. 
Conviction for any above-mentioned violation shall constitute and effect an immediate forfeiture of the license.
E. 
In addition to the above-provided penalties, the Town Board or the Town Code Enforcement Officer/Building Inspector and/or the Town of Wallkill Police Chief may also maintain an action or proceeding in the name of the Town in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of such chapter.
