There is hereby established a fee of $25 for
duplicate tax bills issued by the Borough of Lavallette.
There is hereby established a fee of $25 for
checks issued to the Borough of Lavallette which are returned by the
issuing financial institution for any reason.

There is hereby established a fee of $5 for
the Zoning Map issued by the Borough of Lavallette with an additional
$2.50 for mailing.

There is hereby established a fee of $5 for
tapes for open public meetings held by the Borough of Lavallette or
any of its boards or agencies. There is hereby established a fee of
$3 for compact disks for open public meetings held by the Borough
of Lavallette or any of its boards or agencies.
A request for records in a medium not routinely
used by the Borough of Lavallette shall be charged the actual cost
of duplication, where the Borough can demonstrate that its actual
costs exceed the statutory rates for copying printed material.
The Borough of Lavallette may impose a special
service charge to cover the cost of labor where complying with the
request for documents involves the specific application and programming
of searches for computerized records or other information technology,
nonroutine manual labor, municipal supervision for security reasons
under any law enforcement, state, county, federal or other regulation,
rule or statute, or retrieval from storage or archive. Where a request
for records requires the same, or requires a substantial amount of
manipulation and/or programming of information technology, the Borough
of Lavallette shall charge, in addition to the cost of duplication,
a special reasonable charge related to its labor cost of making the
copy.

Any Department will apply service fees for any extraordinary
expenditure of time and effort to accommodate a request. The service
fees will be based upon the actual direct cost of providing the service
or extraordinary time. If the requestor objects to the fee, the request
is closed, and access to the records is not granted.
A.
All requests for public records pursuant to the Open
Public Records Act, N.J.S.A. 47:1A-5, et seq., shall be made on a
form adopted by the Borough of Lavallette and as may be modified from
time to time. Such form is attached and is hereby adopted as the Open
Public Records Act Request Form of the Borough of Lavallette.[1] The form shall be made readily available at the office
of the Borough Clerk and shall be provided upon request without cost
by facsimile or upon request by mail without cost except for postage.

B.
All such requests shall be accompanied by a fee of $0.05 per page
for letter and legal size paper. A fee of $5 per map for oversized
maps (color) and a fee of $3 per map for oversized maps (black and
white). A page shall be considered as a single sheet of paper of either
8 1/2 inches by 11 inches, commonly called letter size, or 8 1/2
inches by 14 inches, commonly called legal size. Irregularly shaped
items such as plans or milar sheets shall be priced according to market
rates required to reproduce the same, and the Borough of Lavallette
shall have no obligation to maintain facilities for the production
or copying of such maps or irregularly shaped items. A request for
a compact disc (CD) shall be accompanied by a fee of $5 per CD and
a fee for digital video discs (DVDs) shall be accompanied by a fee
of $0.55 per DVD.

No person, group or organization shall use any
municipal gazebo or pavilion for a private function such as a wedding
or other event without paying a fee to the Borough.
A.
The following gazebo and pavilion fee is hereby established.
For rental or use of any municipal gazebo or pavilion for private
or nonprofit functions: a nonrefundable fee of $200.

B.
Any person, group or organization which rents or uses
any municipal gazebo or pavilion for a private or nonprofit function
shall be responsible to clean up the gazebo or pavilion following
completion of the function. No person, group or organization shall
staple, nail or otherwise affix any banner, sign or decorative item
or items to any municipal gazebo or pavilion except to tie the same
to the structure in a manner so that it can be removed without mark
or residue.
C.
Persons using the gazebo shall not walk in or otherwise
damage the flower beds and plantings in the Centennial Gardens.
D.
The throwing or use of rice or bird seed in the gazebo
and Centennial Garden is prohibited. Celebrants may utilize bubbles
in lieu of rice or bird seed.
E.
Any person who shall be convicted of a violation of
a provision of this section shall, upon conviction thereof by any
court authorized by law to hear and determine the matter, be subject
to a fine of no less than $100 and no more than $1,000, imprisonment
not to exceed 90 days or community service of not more than 90 days,
or any combination of fine, imprisonment and community service, as
such court in its discretion may impose. Each day that such violation
exists shall constitute a separate offense.

A.
The duly elected and constituted Mayor of the Borough
of Lavallette may perform marriages and civil unions as provided by
law. In the absence or unavailability of the Mayor to perform such
marriage or civil union, the Council President is hereby designated
pursuant to N.J.S.A. 37:1-13 to perform such marriage or civil union.
B.
A fee of $100 shall be charged for performing any
marriage or civil union. This fee is in additional to statutory license
and other fees required by law. No other honorarium for the performance
of any marriage or civil union may be solicited for performing any
marriage or civil union. An honorarium which is voluntarily tendered
shall be accepted by the Borough and deposited in the general revenue,
or may be rejected and returned in the sole discretion of the Mayor
or Council President performing the marriage or civil union.

C.
Establishment of policy. It is hereby determined by
the Borough Council of the Borough of Lavallette that the performance
of wedding or civil union ceremonies by the Mayor and/or Council President
is an important civic function. Additionally, the performance of this
function by the Mayor and/or Council President requires a significant
commitment of time and requires that the Mayor and/or Council President
incur certain expenses related to travel and other ancillary considerations.
Accordingly, it is the established policy of the Borough of Lavallette,
after due consideration of the above and after evaluation of fees
charged in similar municipalities, that the Mayor and/or Council President
be compensated at the rate of $100 for each ceremony performed. Such
compensation shall be in addition to the Mayor's and/or Council President's
salary as established by ordinance, but shall be paid to the Mayor
and/or Council President as part of his or her salary, under and subject
to all applicable tax laws and regulations.

D.
Prior approval required. The Mayor and/or Council President of the Borough of Lavallette shall not be compensated for performing a wedding or civil union ceremony unless the voucher form for such, required by Subsection E below, has been submitted to the Chief Financial Officer, with the required fee of $100 attached and made payable to the Borough of Lavallette, before the wedding or civil union ceremony takes place. The Borough Council, in its sole discretion, shall have the authority to relax the time constraints of this provision in the appropriate case.

E.
Procedure for approvals. Before being compensated
for officiating at a wedding or civil union ceremony, the Mayor and/or
Council President shall, prior to the ceremony, first submit a proper
voucher form, as determined by the Chief Financial Officer, setting
forth the time, place and date of the ceremony. Thereafter, the voucher
shall be submitted to Borough Council for processing in the ordinary
course.
