No person shall engage in the business of collecting garbage, offal,
ashes, refuse, rubbish or noxious substances within the Town of Gates without
first obtaining a license from the Town Clerk. A fee as set from time to time
by resolution of the Town Board shall be charged for any such license.
Every license issued by the Town Clerk, pursuant to this article, shall
be subject to the following conditions and to such other reasonable conditions
as may be imposed by the Town Board.
A. Vehicles used by licensed waste collectors in the collection
and transportation of garbage, mixed refuse or any other kind of waste within
the area of the Town of Gates shall have watertight enclosed bodies equipped
with a compaction unit.
B. Any firm having two or more such vehicles shall be allowed
to use one service truck.
C. All vehicles used by licensed waste collectors shall
be available for inspection by the Gates Town Clerk or any other person or
persons whom he may designate as his agent prior to the issuance of any license
pursuant to the provisions of this Part 1.
D. Upon payment of the license fee for vehicles used in
such collections and transportation as set forth in this Part 1, the approval
by the Town Board of the application therefor, the Town Clerk shall issue
a license to the owner together with a metal plate which shall be affixed
to a conspicuous and an indispensable part of each and every such vehicle,
on which shall be set forth clearly the official number of such license with
the words "Town of Gates Refuse Collection License."
E. Renewal licenses shall be issued in the same manner and
subject to the same conditions as original licenses and also subject to any
additional requirements for renewal of the license applied for.
F. No license or permit issued under the provisions of this
Part 1 shall be transferable.
G. The Town Board shall have the power to suspend or revoke
a license, granted or renewed, pursuant to this Part 1 for any of the reasons
as may be hereinafter set out in this Part 1.
H. All trucks must have a minimum liability insurance for
personal injury of $100,000 per person and $200,000 per accident and for property
damage, $10,000.
