Except as required otherwise in this chapter,
every hospital, institution, business or industrial use hereafter
established shall provide loading spaces of not less than 14 feet
wide, 60 feet long and 15 feet high. The appropriate number of spaces,
unless specified otherwise by this chapter, shall be determined by
the applicant and shall not be located so as to encroach on streets
or sidewalks or other areas as may be specified elsewhere in this
chapter. There shall be one auxiliary truck waiting space for each
two dock spaces. These requirements shall be exclusive of driveways,
aisles and other necessary circulation areas.
Every hospital, institution, hotel or commercial
or industrial building hereafter erected or established having a gross
floor area of 5,000 square feet or more shall provide and maintain
at least one off-street loading space, plus one additional off-street
loading space for each additional 10,000 square feet of gross floor
area. Any use requiring 1/2 or more of a loading space shall be deemed
to require the full space. Each loading space shall not be less than
14 feet in width, 60 feet in length and 15 feet in height. These requirements
apply to each separate occupancy and are exclusive of driveways, aisles
and other necessary circulation areas.
Off-street parking spaces shall be provided
and maintained as set forth in this section for all uses in all zoning
districts. Such off-street spaces shall be provided at the time:
A. A new building is hereafter erected or enlarged.
B. A building existing on the effective date of this chapter is enlarged to the extent that the cost of construction exceeds 50% of the market value of the building, as shown on the Town of Gates Assessor's records, or to the extent that the building's capacity is increased by more than 50% in terms of the units used in the "Required Parking Spaces" column of §
190-14.
C. The use is changed to another use with greater parking
requirements, provided that if the enlargement of a building existing
at the time hereof is less than 50%, parking space shall be provided
in proportion to the increase only. Any use requiring 1/2 or more
of a parking space shall be deemed to require the full space.
Off-street parking spaces for dwellings shall
be located on the same lot with the dwelling. Other required parking
spaces shall be located on the same parcel or on another parcel, provided
that the furthest parking space is not farther than 200 feet from
a residential unit or 300 feet from the commercial building or use
it is intended to serve, measured in a straight line from the building.
The burden of proving the existence of such off-premises parking arrangements
rests upon the person who has the responsibility of providing parking.
Required parking space shall be available for
the parking of operable passenger automobiles of residents, customers,
patrons and employees only and shall not be used for storage of vehicles
or materials or for the parking of trucks used in conducting the business
or use.

Parking in front yards. Parking spaces shall be allowed in the
front yard for all districts providing that there is sufficient screening
to prevent headlight glare, that the parking shall not be closer than
10 feet to all property lines, and shall meet all other applicable
provisions in this chapter. Loading spaces shall not be located in
any front yard.
Every parcel of land hereafter used as a public
or private parking area, including commercial parking lots, shall
be developed as follows:
A. Parking areas shall have a minimum aisle width of
15 feet for one-way traffic and 24 feet for two-way traffic. The minimum
parking space shall be nine feet in width and 18 feet in length for
90º, 60º and 45º parking or 10 feet in width and 20
feet in length for parking parallel to the aisle.

B. Any parking area which is intended to be used during
nondaylight hours shall be properly illuminated to avoid accidents.
Any lights used to illuminate a parking lot shall be so arranged as
to reflect the light away from all adjoining property.
C. Except for single-family dwellings, any parking area
shall be designed in such a manner that any vehicle leaving or entering
the parking area from or into a public or private street shall be
traveling in a forward motion. Access or driveways for parking areas
or loading spaces shall be located in such a way that any vehicle
entering or leaving such lot shall be clearly visible for a reasonable
distance to any pedestrian or motorist approaching the access or driveway
from a public or private street.
D. The required number of parking and loading spaces,
as set forth in this section, together with driveways, aisles and
other circulation areas, shall be improved with acceptable impervious
material, to provide a durable and dust-free surface or large aggregate
stone or asphalt.
E. All parking and loading areas shall provide for proper
drainage of surface water to prevent the drainage of such water onto
adjacent properties or walkways.
F. The owner and/or lessee of the property used for parking
and/or loading shall maintain such area in good condition without
holes and free from dust, trash and other debris. Trash receptacles
shall be placed in parking lots near entrances, exits and sidewalks
for collection of paper and other litter. These are not to be dumpsters.
G. The parking of a disabled vehicle within a residential
or commercial district for a period of more than one week shall be
prohibited unless such vehicle is stored in an enclosed garage or
other accessory building or otherwise screened, in accordance with
this chapter, from public view.
H. Unless otherwise permitted, no unlicensed motor vehicle
of any type or kind shall be parked or stored on any residentially
zoned property unless it is parked or stored in a completely enclosed
building. No more than one recreational trailer, motor home, boat
or other personal recreational vehicle belonging to an occupant of
the premises may be stored on a driveway or in a required side yard
as long as such vehicle is not used for habitation and does not impede
the view of pedestrians or vehicles from seeing one another for a
reasonably safe distance. The parking or storing of commercial vehicles
or trailers in residentially zoned areas is prohibited, except that
one commercial vehicle not exceeding three-fourths-ton rated capacity
being used by an occupant of the premises may be so parked or stored
on the premises.

I. In all parking areas of more than five vehicles, parking
shall be so distributed as to service the individual units or business.
Parking lots shall be kept small and in other ways broken into smaller
units through provision of islands and plantings.
