The purpose of the residential districts is to maintain and promote suitable living environments and to protect and stabilize the residential character of the district. The districts are to provide for single-family homes at urban standards.
The following uses and their accessory uses are permitted in the R-1-15, R-1-11 and R-1-8 Districts:
A. 
Single-family dwelling.
B. 
Customary home occupation, including dog breeding as permitted pursuant to § 62-6B.

C. 
[1] The occasional sale of personal property, commonly known as "garage sales," "lawn sales" or other similar designation, subject to the following conditions and limitations:

(1) 
Not more than three sales shall be conducted from any residential dwelling unit during any one calendar year.
(2) 
No sale shall be for a period of more than three consecutive days and shall be conducted between the hours of 10:00 a.m. and 9:00 p.m.
(3) 
The term "residential dwelling unit" shall include a multiple dwelling unit.

D. 
Public recreation and parks owned and maintained by the Town of Gates.
E. 
Public buildings and grounds, excluding maintenance, storage or repair facilities.
F. 
Farming, excluding animal husbandry and breeding and the storage of manure.
The following uses and their customary accessory uses are permitted upon issuance of a conditional use permit pursuant to Article XXXII:

B. 
Nursing care homes approved by the Genesee Region Health Planning Council and the New York State Health Department.
C. 
Golf courses, excluding driving ranges, miniature golf facilities, amusement parks, racetracks or other similar uses.
D. 
Public utilities substations and uses, excluding power plants or repair yards, and warehouses or uses of a similar nature.
E. 
Sale of agriculture products, limited to those products grown on the site in question and only during the local harvest season.
F. 
Public, parochial or private schools accredited by the New York State Department of Education.

A. 
Lot areas. Minimum lot area shall be 15,000 square feet in the R-1-15 District, 11,000 square feet in the R-1-11 District and 8,000 square feet in the R-1-8 District. Lot areas shall be increased by 5,000 feet for each additional dwelling unit.
B. 
Lot widths and depths.
(1) 
Minimum lot width shall be 100 feet in the R-1-15 District, 80 feet in the R-1-11 District and 70 feet in the R-1-8 District. An additional 20 feet of frontage shall be required where there is an additional dwelling unit.
(2) 
The lot width may be increased by 10% of the lot depth and the lot depth reduced accordingly, as long as minimum lot areas are maintained. This provision may be applied to all lots as long as the minimum front setback required in these areas is adhered to. The depth to width ratio shall not exceed 2 1/2 to 1.
C. 
Setbacks.
(1) 
Front setbacks shall be as required in § 190-36.
(2) 
Side and rear yard setbacks. Rear yard setbacks shall be not less than 30 feet. Unless required elsewhere, there shall be two side yards for each dwelling unit structure; each side yard shall have a width of not less than 10% of the required lot width at the front setback line, but need not exceed 10 feet. No side yard shall be less than six feet.

(3) 
Corner lots shall have two front yards. The depth of each yard shall depend on the type of street that portion of the lot fronts on.
D. 
Floor areas. Minimum floor areas shall be as follows:
(1) 
R-1-15 single-family dwellings of one floor level: 1,400 square feet; all other types of single-family dwellings: 1,750 square feet.
(2) 
R-1-11 single-family dwellings of one floor level: 1,100 square feet; all other types of single-family dwellings: 1,375 square feet.
(3) 
R-1-8 single-family dwellings with one floor level: 1,000 square feet; all other types of single-family dwellings: 1,250 square feet.
(4) 
Seventy-five percent of the above floor areas shall be required for each additional unit on the site in the appropriate district.
E. 
Building height. Building shall not exceed two stories or 35 feet. Accessory structures shall not exceed 15 feet in height.
F. 
The maximum building lot coverage shall be 25% in the Residential Zone.

Off-street parking and loading areas shall be provided as listed in Article IV.
Signs are permitted as listed in Article V.
Fences, hedges, berms and screen plantings are permitted or, alternatively, shall be required as listed in Article VI.
Site plan approval shall be secured as required in Article XXXIII.
