This chapter is adopted pursuant to the authority of Article 9-A of the General Municipal Law of the State of New York and shall be known as the "Games of Chance Local Law of the Village of Delhi."
A. 
The words and terms used in this chapter shall have the same meanings as such words and terms are used in Article 9-A of the General Municipal Law, unless otherwise provided herein or unless the context requires a different meaning.
B. 
As used in this chapter, the following terms shall have the meanings indicated:
GAMES OF CHANCE
Those as defined in § 186 of the General Municipal Law in which prizes are awarded on the basis of a designated winning number or numbers, color or colors, symbol or symbols determined by chance.
VILLAGE
The Village of Delhi.
Authorized organizations may, upon the obtainment of a license from Village Clerk, conduct games of chance within the Village of Delhi as provided in Article 9-A of the General Municipal Law and as provided further in this chapter. Such games of chance shall be conducted in accordance with the general state law and with the rules and regulations of the New York State Racing and Wagering Board and this chapter.
The conduct of games of chance authorized by this chapter shall be subject to the restrictions imposed by § 189 of the General Municipal Law.
This chapter shall be deemed to include all of the provisions of Article 9-A of the General Municipal Law, except as otherwise provided in this chapter, and any amendment to the provisions of such article to the extent such provisions and amending acts are otherwise applicable to games of chance authorized under this chapter.
Games of chance on the first day of the week, commonly known as Sunday, may not be conducted pursuant to this chapter and appropriate state law and regulation.
The Chief of Police of the Village of Delhi shall exercise control over and supervision of all games of chance conducted under an appropriately issued license. The Chief shall have all those powers and duties set forth in Subdivisions 1 and 2 of § 194 of the General Municipal Law.
In accordance with the provisions of § 188, Subdivision 2, of the General Municipal Law and § 23, Subdivision 1, of the Municipal Home Rule Law, this chapter shall not become operative or effective unless and until it shall have been approved at the next general election held within the Village by the affirmative vote of a majority of the qualified electors of the Village voting upon the proposition.
