Owners of commercially zoned property fronting the main boardwalk may construct and maintain a private connection to the main boardwalk in accordance with this article.
Any part of a private connection to the main boardwalk which is constructed on public property shall be used for no other purpose than to gain pedestrian access to the adjacent property.
All private connections to the main boardwalk shall be designed and constructed in accordance with the following:
A. 
Private connections shall be designed and constructed in all aspects to support a minimum live load of 100 pounds per square foot.
B. 
Stringers shall be oriented perpendicular to those of the main boardwalk.
C. 
Be attached to the westernmost stringer of the main boardwalk with an appropriately engineered stainless steel hanger.
D. 
The attachment to the main boardwalk shall be of a breakaway design; lateral and upward loads may only be restrained using smooth shank nails no larger than 12 penny in size.
E. 
Shall not impose a load greater than 500 pounds per linear foot on the main boardwalk, including both live and dead loads.
F. 
Shall be constructed along the entire length of the private property where it is adjacent to the main boardwalk.
A. 
No private connection shall be constructed until the owner of the adjacent property has first obtained a permit from the City Manager.
B. 
The applicant shall provide the City Manager with any plans and specifications necessary to determine that the proposed private connection complies with this article.
C. 
The City Manager may impose any reasonable conditions as to material type and quality and construction standards consistent with those used for the main boardwalk.
All private connections, whether constructed on public or private property, shall be constructed, reconstructed and maintained at the sole cost of the adjacent property owner; the City shall assume no responsibility.
Where any private connection is constructed in whole or in part on public property, neither the adjacent property owner nor anyone else shall, by virtue of having constructed a private connection, acquire any title to such public property, and the private connection constructed on such public property shall be used for no other purpose than to gain pedestrian access to the adjacent property.
A. 
The owner of the property adjacent to any private connection shall, at his or her expense, at all times maintain and keep in good repair such private connection.
B. 
If the City Manager, in his sole judgment, determines that a private connection has fallen into a state of disrepair, he may require that the adjacent property owner make necessary repairs within a timetable specified by him.
C. 
If the City Manager, in his sole discretion, determines, at any time, that a private connection or any part of a private connection represents a hazard to the public, he may erect a barricade on the main boardwalk denying access to the unsafe portion of the private connection.
The owner of the property adjacent to any private connection shall remove such connection upon 15 days' notice by the City where the City has determined that such connection interferes with the maintenance of the Boardwalk or when such connection is not in the best interest of the health, safety and welfare of the City.
