Owners of commercially zoned property fronting
the main boardwalk may construct and maintain a private connection
to the main boardwalk in accordance with this article.
Any part of a private connection to the main
boardwalk which is constructed on public property shall be used for
no other purpose than to gain pedestrian access to the adjacent property.
All private connections to the main boardwalk
shall be designed and constructed in accordance with the following:
A. Private connections shall be designed and constructed
in all aspects to support a minimum live load of 100 pounds per square
foot.
B. Stringers shall be oriented perpendicular to those
of the main boardwalk.
C. Be attached to the westernmost stringer of the main
boardwalk with an appropriately engineered stainless steel hanger.
D. The attachment to the main boardwalk shall be of a
breakaway design; lateral and upward loads may only be restrained
using smooth shank nails no larger than 12 penny in size.
E. Shall not impose a load greater than 500 pounds per
linear foot on the main boardwalk, including both live and dead loads.
F. Shall be constructed along the entire length of the
private property where it is adjacent to the main boardwalk.
All private connections, whether constructed
on public or private property, shall be constructed, reconstructed
and maintained at the sole cost of the adjacent property owner; the
City shall assume no responsibility.
Where any private connection is constructed
in whole or in part on public property, neither the adjacent property
owner nor anyone else shall, by virtue of having constructed a private
connection, acquire any title to such public property, and the private
connection constructed on such public property shall be used for no
other purpose than to gain pedestrian access to the adjacent property.
The owner of the property adjacent to any private
connection shall remove such connection upon 15 days' notice by the
City where the City has determined that such connection interferes
with the maintenance of the Boardwalk or when such connection is not
in the best interest of the health, safety and welfare of the City.
