Whenever public shade trees are cut down or removed there shall
be planted by the Tree Warden by the end of the following fiscal year
at least one tree of caliper two inches or larger for each four cut
down or removed. The Tree Warden may plant the trees in the public
ways or, if he/she deems it expedient, upon adjoining land, at a distance
not exceeding 20 feet from said public ways, for the purpose of improving,
protecting, shading or ornamenting the same, provided that an easement
shall first be obtained from the owner of such adjoining land in accordance
with MGL c. 87, § 7.
