Pursuant to Section 11 of the Uniform Fire Safety
Act (P.L. 1983, c. 383), the New Jersey Uniform Fire Code shall be adopted and
locally enforced within the Municipality of Chesterfield, except that
inspections required pursuant to said Act shall be conducted by the
Department of Community Affairs of the State of New Jersey, specifically
the Bureau of Fire Prevention within that Department.
The local enforcing agency shall be the Bureau
of Fire Prevention in the Township of Chesterfield. The members of
the Bureau shall consist of the members of the Township Committee
of the Township of Chesterfield and a representative designated by
the Union Fire Company of Crosswicks and a representative designated
by the Chesterfield Hose Company, appointed annually. The local enforcement
agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all
buildings, structures and premises within the established boundaries
of Chesterfield Township, other than owner-occupied one- and two-family
dwellings, and shall faithfully comply with the requirements of the
Uniform Fire Safety Act and the Uniform Fire Code.

The periodic inspections of life hazard uses
required by the Uniform Fire Code on behalf of the Commissioner of
Community Affairs shall be conducted by the State of New Jersey, Department
of Community Affairs, Bureau of Fire Safety.
The local enforcing agency established by §
114-2 of this article shall be a part of the Department of Public Safety of Chesterfield Township and shall be under the direct supervision and control of the Director of the Department of Public Safety of Chesterfield Township.
The local enforcing agency shall be under the
supervision of a Fire Official who shall be appointed by the Township
Committee of Chesterfield Township. In making this appointment, the
Township Committee shall make the appointment from the persons or
persons recommended by the Bureau.
The Fire Official shall serve for a term of
one year. Any vacancy shall be filled for the unexpired term.

Such inspectors and other employees as may be
necessary in the local enforcing agency shall be appointed by the
Township Committee of the Township of Chesterfield upon recommendation
of the Advisory Board, except that to the extent that inspections
are conducted by the State of New Jersey, Department of Community
Affairs, on behalf of the Township of Chesterfield, the local Advisory
Board shall have no such input.
Inspectors and other employees of the enforcing
agency shall be subject to removal by the Township Committee upon
the recommendation of the Fire Official for inefficiency or misconduct.
Each inspector or employee to be so removed shall be afforded an opportunity
to be heard by the Township Committee or a designated hearing officer.
Pursuant to Section 15 and 17 of the Uniform
Fire Safety Act, any person aggrieved by any order of the local enforcement
agency shall have the right to appeal to the Construction Board of
Appeals of Burlington County.
The inspection and permit fees established by
the Uniform Fire Code adopted February 18, 1985, as amended and supplemented,
shall be charged by the Fire Official under this article.
