No person shall strip, clear, or grade any parcel
of land in such a manner that allows siltation or sediment to be carried
from the property onto adjacent properties or into streams, creeks
or lakes.
Prior to beginning such work, in addition to all other
approvals or permits that may be required, a siltation/sedimentation
control system shall be installed which will completely collect these
materials and prohibit them from leaving the property.
Such systems shall be maintained in working order
until such times as the site is completely revegetated. At that time,
the system may be abandoned and the area restored.
All such property shall be revegetated within 30 days
of the completion of work or the discontinuation of work for more
than two weeks. In no case will the land remain unvegetated beyond
the end of the current construction season without the specific approval
of the Town Board and the posting of acceptable security.
All systems for drainage constructed at the expense
of the property owner, builder or developer, after approval and acceptance
by the Town Engineer, shall become the property of the Town.
New lots or parcels. Upon approval of the drainage
plan, if the drainage improvements are not completed at the time of
inspection by the Town Engineer and Code Enforcement Officer, the
developer shall post security in a form acceptable to the Town Board
in an amount to be set by the Code Enforcement Officer, but in no
event less than $500 per lot. Such security shall be maintained and
released as each lot is developed and a certificate of occupancy issued,
or at such other time as deemed necessary by the Codes Enforcement
Officer. However, a developer may contract with the builder to post
equivalent security acceptable to the Town Board to be maintained
for the same periods, at which time the security posted by the developer
shall be released.
Existing lots or parcels. Upon application for a permit
to erect a building on an existing lot or parcel of land, the builder
shall post security in a form acceptable to the Town Board in an amount
to be set by the Codes Enforcement Officer, but in no event less than
$500. Such security may be retained by the Town until proper drainage
is provided as required by the Codes Enforcement Officer.
Security so posted shall be available to the Town
at any time to repair or maintain the drainage system in the event
the builder or developer declines or is unable to do so promptly upon
notice.
