The purpose of this chapter shall be to improve and promote the health, safety and general welfare of the community, including the protection and preservation of the property of the Village and its inhabitants by control and removal of dead trees.
All owners of real property on which dead or abandoned trees are permitted to stand which produce or cause to be produced a dangerous condition likely to cause imminent damage to a structure or building located on said premises or to a structure or building on lands adjoining said premises shall cut down said tree or trees and remove the same from the premises within five days after the mailing of a notice, in writing, by the Building Inspector, sent by registered or certified mail to the owner or owners shown on the current assessment roll to the address shown thereon.
All owners of real property on which dead or abandoned trees have been felled which produce a hazardous or dangerous condition so as to be exposed to the risk of fire or so as to produce an uncleanly condition shall cause such felled trees to be removed from the premises thereof within five days after the mailing of a notice, in writing, by the Building Inspector, sent by registered or certified mail to the owner or owners shown on the current assessment roll to the address shown thereon.
In the event that the owner or owners shall fail to cut down dead trees and shall fail to remove the fallen dead trees within five days after the mailing of said notice as herein specified, the Village of Highland Falls is hereby authorized to cut down and remove the same after they have been cut down, at the expense of the owner or owners, which expense of such work shall be reported to the Village Board, who shall direct the same to be levied against the premises upon which said work was done.
Any person violating any of the provisions of this chapter shall be guilty of a violation and, upon conviction thereof, shall be punishable by a maximum fine of $250 or by a term of imprisonment of not more than 15 days, or both. Each day that a violation of or failure to comply with any provision of this enactment or any regulation promulgated hereunder by the Board of Trustees occurs shall constitute a separate and distinct violation.
