[HISTORY: Adopted by the Board of Trustees of the Village of Lancaster 6-29-1976 by L.L. No. 14-1976 (Ch. 77 of the 1976 Code). Amendments noted where applicable.]
The Board of Trustees of the Village of Lancaster, being fully cognizant of the fact that considerable damage has been done to the property of residents of the Village of Lancaster, and being also aware that because of the limited confines of areas within the Village of Lancaster, and the close proximity thereto of residential and other structures and property inhabited and used by residents of the Village, and being further aware that the use of firearms in the Village is a matter affecting the public health, safety and welfare, which matter should be subject to control by the Village of Lancaster, intends by the enactment of this chapter to regulate the discharge of firearms within the Village of Lancaster.
No person shall, except in self-defense and when reasonably necessary for the protection of life or property, fire or discharge or cause to be fired or discharged any machine gun, rifle, shotgun, air rifle, sling shot, bow and arrow or firearm, as defined in Section 265.00 of the Penal Law, within the boundaries of the Village of Lancaster.
The prohibitions contained in this chapter shall not apply to any officer of law while engaged in the protection of the safety of the people of the State of New York, nor shall they apply to a member or guest of a gun club engaged in any shooting upon such gun club premises which, except for this chapter, is permitted by law.
Nothing contained in § 152-4 of this chapter shall prevent the Board of Trustees of the Village of Lancaster from maintaining an action or proceeding in the name of the Village in a court of competent jurisdiction to compel compliance with, or to restrain by injunction the violation of any of, the provisions of this chapter or any rule or regulation promulgated hereunder.
