It is the intent of the Borough Council of the Borough of Eddystone,
Delaware County, Pennsylvania, to promote the general health, safety
and welfare of the residents of the Borough of Eddystone and it is
determined that the uncontrolled consumption of alcoholic beverages
in public is detrimental to health and safety.
It shall be unlawful for any person to consume, whether inside or
outside of a motor vehicle, in or upon public ways, parks, places
or property within the Borough, any alcoholic beverage or to possess
an open container, bottle or can of alcoholic beverage.
"Public property" shall include all property owned by the Borough;
"public way or place" shall mean every way or place open to the use
of the public as a matter of right for the purpose of vehicular or
pedestrian travel, including sidewalks, streets, highways, buildings,
other than those public buildings with a liquor license, parking lots,
parks and recreation areas.

Any person who shall be convicted of a violation of any of the provisions
of this article before any District Justice shall be sentenced to
pay a fine of not more than $600 and costs of prosecution and, in
default thereof, to imprisonment in the county jail for a term not
to exceed 30 days.
