Hereafter, it shall be unlawful for an owner
of any dog or dogs, licensed or unlicensed, to permit such dog or
dogs to run at large unaccompanied by the owner or keeper.

It shall be the duty of the Borough police or
any duly authorized agent of the Borough to seize and detain any dog
or dogs, whether they are licensed or unlicensed, which are found
running at large either upon public streets or highways of the Borough
or upon the property of other than the owner of such dogs. The Borough
police or any duly authorized agent of the Borough is hereby authorized
and empowered to go upon any premises and enter any building to seize
and detain any dog or dogs which have been found running at large
unaccompanied by the owner or keeper when such Borough police or any
duly authorized agent of the Borough is in the immediate pursuit of
any such dog or dogs.
Any police officer may kill any dog which threatens
persons or property.

It shall be the duty of any police officer or
any duly authorized agent of the Borough of Eddystone, who witnesses
any dog running at large in conflict with the provisions of this article
or who receives information of any dog so running at large, to seize
such dog and to convey it to the place designated by the Borough Council
as a pound. Notice of such seizure shall be sent to the owner of such
dog in the manner prescribed by law, and such dog may be redeemed
by the owner thereof within the time specified by law upon payment
of the charges incurred by reason of such detention. The owner of
a dog so detained shall pay to the Borough the sum of $3 for the apprehension
of the dog, plus the sum of $1 for each additional day or any part
thereof to cover expenses incurred by reason of its detention.
Any dog or dogs not claimed in accordance with
the provisions of this article shall be disposed of in accordance
with the Acts of Assembly of the Commonwealth of Pennsylvania in such
case made and provided.
It is the intent that this article shall be
supplemental to any laws of the Commonwealth of Pennsylvania hereinbefore
or hereinafter adopted covering dogs within the Commonwealth of Pennsylvania
and specifically in the Borough of Eddystone. Should any of the provisions
of this article be contrary to the provisions of any Act of Assembly,
it is the intent that the Act of Assembly shall supersede this article.
The proper officers of the Borough are authorized
to enter into such agreements or contracts with any individual, individuals
or corporations as may be reasonably necessary to implement the provisions
of this article in regard to the care and custody of such dogs detained
by the Borough pursuant to the provisions of this article and to provide
for the reasonable compensation of such person, persons or corporations
for such services.

No person shall cause, suffer or allow any dog
to be upon the highways, streets, alleys, walkways or any public property
within the Borough of Eddystone without being attended and without
being restrained by a leash or other appropriate restraining device.

No person shall cause, suffer or allow any dog
to be upon the private property of another within the Borough of Eddystone
without the express authority or permission of the owner of the property.

No person shall cause, suffer or allow any dog to defecate upon any property within the Borough of Eddystone without the express authority or permission of the owner of the property, except as set forth in § 70-22 of this article.

A person may cause, suffer and allow a dog to
defecate in that area of any street or alley lying between the curblines
or, where there are no curbs, in the paved area and the berm of any
street or alley and in that area between the curbline or the berm
and the sidewalk, provided that said person shall, immediately after
the dog has deposited his feces upon said area, remove or cause to
be removed in a sanitary manner all such feces so deposited, and provided
that said feces shall be wrapped or enclosed and deposited in said
person's garbage or in some other place approved by the Health Officer
of the Borough of Eddystone in such a manner so as not to cause an
odor or a hazard to the health of any resident of the Borough.

It shall be unlawful to own, harbor or keep
in custody any dog which disturbs the peace by barking, howling or
making other loud noises to the annoyance and discomfort of any person
in the Borough of Eddystone. The barking, howling or making of other
loud noises by any dog for 1/2 hour or more shall be deemed to be
a disturbance of the peace and a cause of annoyance and discomfort
to persons in the Borough of Eddystone.

Any owner, person, firm, association or corporation
who shall violate or fail or refuse to comply with any provision of
this article shall, upon conviction before a District Justice, be
sentenced to pay a fine of not more than $600, together with the costs
of prosecution, and, in default of the payment of the fine, to imprisonment
in the county jail for a term not to exceed 30 days, or both.
