This article shall be known and may be cited as a "Local Law Amending Local Law No. 2-1967 of the Town of Clifton Park, Entitled 'Local Law Relating to Zoning for the Town of Clifton Park, Providing for the Creation of a Planned Unit Development District to be known as "Maxwell Drive PUD."'"
Chapter 208, Zoning, of the Code of the Town of Clifton Park and the Zoning Map[1] of the Town of Clifton Park as set forth therein and made a part thereof be and the same hereby are amended by changing from Residential District R-1 and Business Non-Retail B-1 a portion thereof as hereinafter described and by creating within the boundaries of said newly described area a planned development district to be known as "Maxwell Drive PUD."

The area of Maxwell Drive PUD consists of approximately 15.9 acres ("project site") and is bounded and described as follows: All that tract, piece or parcel of land situate in the Town of Clifton Park, Saratoga County, New York, comprising an irregular lot lying northerly of Mooney Way, westerly of Maxwell Drive, and southerly of Plank Road and Via DaVinci Drive and being more particularly bounded and described as set forth on Schedule A attached hereto.[1]

A. 
Maxwell Drive PUD shall consist of up to 38 multifamily residential condominium units in up to 12 buildings. A maximum of four of the said buildings shall lay on the south side of the Bear Brook ("south portion") and up to eight of the said buildings shall lay on the north side of the Bear Brook ("north portion"). The units will be marketed to active adults, and a requirement of purchase from the developer/builder will be that the owner(s) of each unit will be the minimum age of 55 years or older at the time of transfer of title. Maxwell Drive PUD shall have at least two stormwater basins consistent with best practices for stormwater management and will be designed consistent with § 208-69.1A(3) as amended in year 2007.
B. 
Each of the said buildings shall consist of one to four two-story dwelling units.
C. 
Approximately seven acres, plus or minus, of the project site shall be preserved and set aside as open space, which will include buffer strips, building setback areas, sensitive environmental habitat, the Land Conservation Overlay Zone and the stormwater management. The open space will provide the Town of Clifton Park with trail linkage potential.
Before construction of Maxwell Drive PUD is started or any building permit is issued relating thereto, final plans and specifications shall be submitted to and approved by the Town Planning Board and shall be filed with the Town Clerk.
There shall be one point of ingress and egress to service the north portion of the Maxwell Drive PUD from Maxwell Drive. There shall be two points of ingress and egress to service the south portion of the Maxwell Drive PUD, one from Mooney Way and one from Maxwell Drive. The road systems that service the Maxwell Drive PUD shall be privately owned and maintained and meet the standards and regulations for such roads.
A. 
Water shall be provided by the Clifton Park Water Authority.
B. 
The sewer system is to be serviced through the Saratoga County Sewer District No. 1.
All improvements shall be designed and constructed pursuant to plans and specifications approved by a duly licensed engineer or architect and by the Town Planning Board, and when completed and prior to the issuance of a certificate of occupancy, the duly licensed architect or engineer shall certify to the Town of Clifton Park that the improvements were constructed in compliance with the New York State Building Code. The engineer or architect performing the work herein described shall be employed by and at the sole expense of the developer, and all construction, during performance thereof and upon completion, shall be subject to the inspection and approval of the Town Building Inspector.
This amendment shall be deemed automatically revoked and the zoning shall revert to its existing zoning status as it appears in the Clifton Park Town Code on October 20, 2008, if, within 36 months from the effective date of this article, commencement of the construction of dwelling units has not begun or, if after construction has begun, unless substantial progress continues without undue interruption thereafter.
