This chapter shall be known as "Local Law 1-1988,
A Local Law Prohibiting Loitering in the Village of Clyde, New York."
The purpose of this chapter is to prevent minor
incidents of undesirable conduct and inchoate crimes in public areas
for the public welfare, safety and good order of the Village of Clyde
and its citizens.
It shall be unlawful for any person to loiter
within the Village of Clyde. The term "loiter" is hereby defined as:
A.
Remaining in or wandering about in a public place
for the purpose of begging, prostitution or for the purpose of possessing,
selling or using any illegal drugs.
B.
Remaining or wandering about school grounds and not
having any reason or relationship involving custody of or responsibility
for a pupil or student, or any other specific, legitimate reason for
being there and not having written permission from anyone authorized
to grant the same.
C.
Sleeping in any place of restricted public access.
Any person, upon conviction of a violation of
this chapter, shall be fined a sum of money not less than $50 nor
more than $100 for the first offense, or 15 days in jail, and not
less than $150 nor more than $200 for the second or any subsequent
offense within a twelve-month period, or 15 days in jail.
