No person shall place, erect, move or remove
a balcony, canopy, awning, marquee, clock, or other structure or advertising
device without a permit from the Inspector of Buildings, even though
a license therefor has been granted by the City Council under the
provisions of MGL c. 85, § 8.

A.
Definition. "Construction dumpsters" shall mean any
dumpster receptacle of any size used for the temporary collection
of debris from demolition, construction, renovation, rehabilitation
or other alteration of a building or structure.
B.
Permit. A construction dumpster used for construction
activity in connection with a building or demolition permit shall
be considered as part of such permit and shall be governed by the
provisions of the State Building Code. No separate permit shall be
required for a construction dumpster.
C.
Disposal. Disposal of debris for a construction project
shall be governed by the provisions of MGL c. 40, § 54,
as amended, and MGL c. 111, § 150A, as amended.
D.
Removal of dumpster. Construction dumpsters shall
be removed from a construction/demolition site within 10 days of completion
of the construction/demolition activity covered by the permit therefor
as determined by the Building Official who issued the permit.
E.
Penalty for violation.
(1)
Violations of Subsection C shall be punished as provided in the applicable statutes governing such disposal.
(2)
Violations of Subsection D shall be subject to the following criminal or noncriminal disposition:
(a)
Criminal disposition. Upon criminal complaint, a person who violates a provision of Subsection D shall be, if so found by the court, guilty of a separate offense for each day or part of a day during which the violation is committed, continued, or permitted. Each offense, upon conviction, is punishable by a fine not to exceed $100.
(b)
Noncriminal disposition. Any person who violates any provision of Subsection D may be penalized by a noncriminal disposition as provided for under § 1-6 of this Code and MGL c. 40, § 21D, as amended. This section shall be enforced by a Building Official of the City of Lowell who shall issue a notice to appear in court. The penalty for each violation shall be $50 for each day or part of a day during which the violation is committed, continued or permitted.
