As used in this article, the "Village of Montour
Falls Cemetery" shall mean that tract or parcel of land owned by the
Village of Montour Falls, New York, lying generally west of Mill Street
and bounded on the east by Mill Street, on the north by She Qua Ga
Creek and on the south by Mill Street and private property owners,
and being those premises depicted on the Schuyler County Tax Map as
being parcel number 86.11-1-1.
A.
As used in this article, the term "general public"
shall mean all members of the public other than Village officials
of the Village of Montour Falls, whether elected or appointed, including,
but not limited to, employees of the Public Works Department and Cemetery
Commissioners, together with those persons granted permission by resolution
duly adopted by the Village Board of the Village of Montour Falls.
B.
At no time, whether during the hours the Village of
Montour Falls Cemetery is open to the general public or otherwise,
will loitering by any person or persons be allowed. As used in this
article, the term "loitering" shall mean loitering or remaining in
the cemetery either alone or with one or more other persons for no
immediate legitimate purpose.
The Village of Montour Falls Cemetery shall
be closed to all members of the general public from April 1 through
October 15 during the hours 9:00 p.m. to 6:00 a.m., seven days a week,
and from October 16 through March 31 during the hours of 6:00 p.m
to 6:00 a.m., seven days a week.
A violation of this article shall be punishable
by a fine of up to $250. Any prosecution for violation of this article
may be in addition to prosecution for any similar offenses pursuant
to the Penal Law of the State of New York, and any such sentence for
the conviction of this article may require the payment of restitution
for either damage caused to personal property or cleanup costs incurred
by the Village of Montour Falls.
