[HISTORY: Adopted by the Board of Trustees of the Village of Montour Falls 3-18-2002 by L.L. No. 2-2002. Amendments noted where applicable.]
This chapter is enacted pursuant to the provisions of the Village Law of the State of New York and provisions of the Municipal Home Rule Law of the State of New York.
The Board of Trustees of the Village of Montour Falls hereby determines that the discharge of firearms within the Village limits poses a threat to the health, welfare and safety of the residents of the Village, and it is the purpose of this chapter to prohibit the discharge of firearms within the corporate limits of the Village of Montour Falls.
As used in this chapter, the following terms shall have the meanings indicated:
FIREARM
Any pistol, revolver, rifle, shotgun, or other implement, whether loaded through the muzzle or otherwise, which discharges a bullet, cartridge, shell, shell shot, arrow, pellet, or other object propelled by the burning or explosion of gunpowder, electronically, by high pressure from pumping, gas cartridge, by spring which is set by a cocking or cranking operation, by the application and release of tension or pressure to a bowstring, or other means. This definition shall include any firearm classified as illegal by the Penal Law of the State of New York, as the same may be from time to time amended.
No person shall discharge a firearm within the corporate limits of the Village of Montour Falls unless:
A. 
Such person is a law enforcement officer in the execution of his/her office.
B. 
Such discharge of a firearm is done in an organized and certified indoor pistol range for the training and qualifying of law enforcement officers.
C. 
Such discharge of a firearm is done in self-defense as permitted and defined by the Penal Law of the State of New York.

This chapter shall not apply to the following wetlands and other properties of the State of New York as shown on the tax rolls of the Village of Montour Falls:

Any person committing an offense and convicted of violating any provision of this chapter shall be punishable by a fine not exceeding $250 for each offense or imprisonment for a period not exceeding 15 days, or both fine and imprisonment. The repetition of an offense against the provisions of this chapter shall constitute, for each day the offense is repeated, a separate and distinct offense hereunder.
