The President of Borough Council, the Mayor and the Borough Secretary
are hereby authorized and directed to execute a curbside recycling collection,
processing and marketing agreement with the Borough of Stroudsburg, said agreement
being attached hereto and made a part hereof as if set forth in this section.[1]

The purpose of the agreement is to provide a biweekly curbside collection
of recyclable materials for the residents of East Stroudsburg and Stroudsburg
by July 1, 1990, so that the boroughs comply with Act 101 of 1988.[1]

The agreement shall be effective upon approval of an authorizing ordinance
by both Borough Councils. There shall be no established termination date,
but either municipality may terminate the agreement after giving the other
party at least 24 months' written notice.
Each municipality shall be responsible to acquire the equipment listed
in their respective Municipal Recycling Grant from the Department of Environmental
Resources. The recycling employees, one from each municipality, shall be responsible
for maintenance of the recycling equipment. In the event that either municipality
terminates the agreement, the other municipality shall retain all equipment
to continue the service for its residents and businesses. If the municipalities
mutually agree to terminate the agreement, the assets acquired with grant
funds shall be disposed of in accordance with Department of Environmental
Resources regulations and the Borough Code.
Each municipality will direct one employee to perform recycling collection,
processing and maintenance. The Borough Managers of the municipalities shall
share responsibility for administrative tasks. During the collection week,
three days shall be reserved for collection in East Stroudsburg, and two days
shall be reserved for collection in Stroudsburg. The municipalities shall
administer their own recycling grants but shall jointly apply for recycling
performance grants. The joint recycling program shall be headquartered on
the lands of the Borough of East Stroudsburg located near the former joint
landfill.
The municipalities shall share equally the expenses and revenues of
the joint program. The finances of the program shall be managed through a
joint recycling account. Each municipality shall deposit $3,000 to open the
joint recycling account If the joint recycling account balance exceeds $1,500
at the end of the fiscal year, the amount greater than the $1,500 shall be
split equally between the municipalities.
A.
Each municipality shall supply one employee to perform
the task of the recycling program. The Public Works Director of the Borough
of East Stroudsburg shall monitor the recycling employees.
B.
The Public Works Director shall make reports to the Borough
Manager of East Stroudsburg Borough.
C.
The Borough Managers and two Council members from each
municipality shall meet annually to determine marketing strategy for the following
year.
