A. 
The following rules and regulations are hereby adopted and promulgated for the use of the parks and recreation properties and facilities of the Borough of East Stroudsburg, Monroe County, Pennsylvania:
(1) 
The use of bicycles is prohibited except in specific areas, as designated by the Borough Council of the Borough of East Stroudsburg.
(2) 
The playing of golf is prohibited.
(3) 
No pets shall be permitted in any park facility, except as provided below, either with or without a leash, and both the attendant and/or the owner shall be held responsible for this violation.
(a) 
At Zacharias Pond Park, pets are not allowed on the playground, playing field areas and pavilion area. However, pets are allowed around the walking path and in the wooded area as long as they are on a leash not to exceed six feet in length.
(b) 
At Gregory's Pond Park, pets shall be allowed as long as they are on a leash not to exceed six feet in length.
(c) 
At both Zacharias Pond Park and Gregory's Pond Park, signs will be posted directing owners/attendants to the areas where pets are allowed.
(d) 
The owner/attendant is responsible for cleaning up after the pet regarding excrement.
(4) 
No person or persons shall enter or use any parks facility except during the hours of operation.
(5) 
No parking area or any portion of the parks and recreation properties and facilities of the Borough shall be used as a thoroughfare for the use of motorbikes, motorcycles, ATVs, buses, or trucks, at any time. Vehicles shall not exceed the posted speed limit of 10 miles per hour. Large trucks or equipment shall not be parked or permitted to be parked in any parking lot or space.

(6) 
No person or persons shall remove any equipment or furnishings whatsoever from any parks facility, including playgrounds, swimming pools, buildings or other recreation facilities used in connection therewith, or from their usual or accustomed place or places or damage or deface the same, and no person shall damage or deface any trees, plants, bushes, shrubbery, lights or other property in or upon the parks and recreation facilities or used in connection therewith.
(7) 
No person or persons shall commit a breach of the peace, such as vagrancy or riotous or disorderly conduct, engage in fighting, assault, quarreling or inciting others to fight or engage in any other unlawful act tending to imperil or endanger the safety of the occupants of the parks and recreation facilities or to damage the property or equipment thereof.
(8) 
No person or persons shall use publicly profane, blasphemous or indecent language or commit open lewdness or any act of public indecency or make any indecent exposure of the person.
(9) 
No person or persons shall be found in a state of intoxication or drunkenness or consume within or upon the parks and recreation facilities and their respective parking or access areas any beer, wines or intoxicating liquors or use narcotics of any type. Alcoholic beverages and narcotics are specifically prohibited anywhere on Borough park properties.
(10) 
Hours.
(a) 
The normal hours of operation of all the parks for use by the general public shall be 8:00 a.m. to 9:00 p.m. Any person found in the parks between 9:00 p.m. and 8:00 a.m. shall be in violation of this subsection and, upon conviction by the District Magistrate, shall be subject to the fines and penalties as set forth in § 114-12 with the exceptions noted below and further in this chapter.
(b) 
Certain parks facilities, such as the swimming pool and skatecourt, shall have their own hours of operation specifically for those facilities.
(c) 
Hours may be extended for special events as approved by the Borough Council.
(11) 
No person or person shall park or operate a vehicle upon any of the grass or nonpaved areas of the parks or in any areas posted for no parking. Vehicles shall be parked only within marked paved parking spaces. Wherever a space is marked off for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this article for any person to park a vehicle or allow it to remain parked otherwise.
(12) 
No person or persons, other than employees of the Borough of East Stroudsburg, shall vend, distribute, sell, peddle or offer for sale for any purpose any commodity or article or service of any kind or any food within any park except when authorized by the Recreation Board.
(13) 
No person or persons shall wash, clean, polish, grease, lubricate or make repairs to any vehicle or any other article or item of personal property within any park except in case of emergency.
(14) 
No person or persons shall gamble in any form within any park property.
(15) 
No person or persons shall ride or lead or graze any horse or pony within any park except by written permission of the Recreation Board.
(16) 
No person or persons shall within any park discharge any firearms, air guns, or BB guns or possess or use any knives with a blade of more than six inches, slingshots, bows, or any other type of weapons.

(17) 
No camping, hunting or trapping is allowed within any park property.
(18) 
No person or persons shall bring into or deposit into any park, playground or recreation facility trash receptacle any residential household garbage, trash, rubbish, refuse, building materials or any other waste materials.
(19) 
No person or persons shall set afire in any park except in grills specifically provided for cooking purposes.
(20) 
No person or persons shall carry or discharge within any park any firecracker, fireworks or other missile-propelling instruments or explosives or other dangerous articles which have such properties as to cause annoyance or injury to any person or property.
(21) 
No person or persons shall park or leave any vehicle or permit to park or leave any vehicle in any parking lot or areas of any Borough park or recreation facility after closing hours, without the express written permission of the Borough Manager or his/her designee.

(22) 
No person or persons shall post or distribute any banners, signs or posters of a political or commercial nature at any park unless authorized in writing by Borough Council.
(23) 
No person or persons shall climb any building, ballfield fencing or onto or into the roofs of any structures within any park.
(24) 
No person or persons shall feed or provide food for waterfowl (e.g., ducks or geese) or any other wildlife at any park or recreation property or facility.

(25) 
No person or persons shall utilize sound amplification equipment (microphones, speakers, sound systems, etc.) to play or sing music or announce, give speeches, or otherwise broadcast amplified sound at any park or recreation property or facility, unless such use is specifically authorized in advance by the Recreation Board in conjunction with an approved special event.

(26) 
No person, group or organization shall solicit alms or contributions for any purpose on park grounds or property without prior advance permission from the Recreation Board.

No person shall bathe, wade, or swim in any park stream, pond, lake, or waters.

(28) 
No person shall use or operate a boat, canoe, inflated float or raft in any park stream, pond, lake, or waters without authorization from the Borough Manager.

(29) 
No person shall use skis, a sled, cart or other vehicle on runners or wheels, anywhere on park grounds except at such times and in such places as may be designated therefor by the Recreation Board.

No person shall skate, sled, walk or go upon any ice on park grounds or property, except at such time and upon such places as may be designated therefor by the Recreation Board.

A. 
Rules and regulations. The following rules and regulations are hereby established for use of the Dansbury Park swimming pool facilities:
(1) 
Only proper swimming attire may be worn in the pool. No cut-offs, jeans or other such nonswim wear is permitted.
(2) 
All children under 12 years of age must be accompanied by an adult.
(3) 
All swimmers shall obey lifeguard instructions.
(4) 
Staff lifeguards shall have the right to eject any swimmer who, in their opinion, is improperly attired or who disobeys pool rules or instructions. No refund of admission fees.
(5) 
Borough Council may, by resolution, revise or amend the above list of rules and regulations.
B. 
Schedule of user fees.

To purchase a season pass at the resident rate, you must have identification showing you are a resident of the Borough of East Stroudsburg (not just a resident of the East Stroudsburg Area School District). You must present your season pass card every day in order to be admitted.
(c) 
Under an agreement with the Smithfield Township Board of Supervisors, residents of Smithfield Township may also purchase a season pass at the resident rates in effect, subject to annual renewal of the agreement between the Borough and the Township.

Season swimming pool passes shall be sold at the office of the Stroud Region Open Space and Recreation Commission (SROSRC) located in the Community Center Building adjacent to Dansbury Park, at 15 Day Street.

(5) 
Rates for pool parties. Dansbury Park Swimming Pool is available for rent for private swim parties in the evening from approximately 7:30 p.m. to 10:30 p.m. Following are requirements for rent of the pool:
(a) 
Lifeguard services shall be provided by pool staff only. The number of lifeguards required shall be determined by the number of persons signed up, in advance, to attend the party. The Pool Director may specify additional lifeguard staff to work the party as deemed necessary in his/her sole judgment.
(b) 
Fees charged must be paid in advance at the time of reservation. Pool parties may only be scheduled in person at the East Stroudsburg Borough Municipal Building, not at the swimming pool.
(c) 
Scheduling of a pool party is dependent on the availability of pool staff. The Borough Office will notify the applicant within five days of application to confirm the scheduled date.
(d) 
Once a pool party is under way, there shall be no admittance to the swimming pool without special arrangements in advance. The door to the bathhouse shall be locked as there may not be staff available to man the entrance.
(e) 
Applicants for a pool party may bring their own food and refreshments to the pool, to be set up on tables to be provided by pool staff. No glass containers are permitted in the pool area. Alcoholic beverages are prohibited anywhere in Dansbury Park. Smoking is not permitted in the pool area. Applicants shall be expected to remove and/or dispose of all food after the party and to clean up after the group's use.
(f) 
The pool will close at the normal 7:00 p.m. closing time and reopen for the private group pool party after all pool patrons leave. A representative of the applicant may enter the pool area at approximately 7:10 p.m. to set up food and/or activities for the party. After completion of the party and cleanup afterward, all participants shall be expected to leave the pool area by 10:45 p.m. at the latest.
(g) 
The applicant and all participants in the pool party shall obey all swimming pool regulations (i.e., no diving, no running, etc.) and shall obey the instructions of all pool staff persons. Failure to follow all regulations and/or instructions shall be cause for cessation of the pool party, discharge of all participants from the pool grounds, and forfeiture of any fees paid.
(h)

D. 
Operating hours. The Dansbury Park pool will be open for public swimming Monday through Friday from 12:30 p.m. to 7:00 p.m., and on Saturdays and Sundays from 12:00 noon to 7:00 p.m., weather permitting.
(1) 
From noon until 12:30 p.m. Monday through Friday, a portion of the north end of the pool will be utilized for a “lap swim” only.
(2) 
The swimming pool or a portion thereof may close early on specified and announced dates for swimming meets.
(3) 
The pool staff has complete authority to close the pool temporarily for all swimming immediately, if necessary, due to weather conditions, lack of sufficient attendance, staffing issues, health conditions, or for any other reason that may not be under the control of the pool staff.
(4) 
Borough Council may, by resolution, revise or amend the above operating hours.

A. 
Rules and regulations. The following rules and regulations are hereby established for use of the Dansbury Park skatecourt facility:
(1) 
Helmet, knee pads and elbow pads are recommended to be worn by skaters at all times.
(2) 
Do not proceed down any ramps until clear of skaters. Take turns; be courteous to other skaters.
(3) 
Skaters shall skate at their own risk.
(4) 
No bicycles, mountain bikes or scooters allowed.
(5) 
No pushing, fighting, profanity or graffiti.
(6) 
No food or beverages allowed inside skatecourt.
(7) 
No smoking, drugs or alcohol permitted. If found, immediate removal from park and loss of skating privileges.
(8) 
No weapons of any sort shall be tolerated. Removal and loss of skating privileges.
(9) 
No inverted skating maneuvers permitted.
(10) 
No climbing on fence.
(11) 
Borough reserves the right to limit the number of skaters inside skatecourt.
(12) 
Borough staff/personnel have the authority to require the removal of any skater who violates skatecourt rules and suspend such skater from future skating privileges.
(13) 
Children age 10 and under must be accompanied by a responsible adult age 18 or older.
(14)

(15) 
Use of skateboards or skates not permitted anywhere else in Dansbury Park outside of the skatecourt facility.
(16) 
No trespassing when skatecourt is closed. Violators will be prosecuted.
(17) 
Borough Council may from time to time, by resolution, revise or amend the above list of rules and regulations for the use and operation of the skatecourt, including the establishment of temporary regulations. Any such temporary regulations shall be posted at the skatecourt and shall have the same force and effect as any other provision of this chapter.

Operation hours.
(1) 
The schedule hours of operation for the Dansbury Park skatecourt shall be as follows:

During school year:

A. 
Rules and regulations. The following rules and regulations are hereby established for use of the pavilions located at Dansbury Park and Zacharias Pond Park.
(1) 
The pavilions, including tables, grills, and related facilities, are provided for the nonexclusive use of the public for family gatherings, company picnics and other small- or medium-size group events.
(2) 
Advance reservations for use of tables at the pavilions may be made up to six months in advance, as provided below.
(3) 
Use of the Dansbury Park pavilion for exclusive use by one group or organization, or for large-size groups or special events, shall require review and approval by the Borough Recreation Board, and Borough Council, as applicable.
(a) 
Requests for such special event use shall be made in writing to the Borough Office, at least five weeks in advance of the requested date, to enable review of such request by the Recreation Board.
(b) 
The Recreation Board shall, at its sole discretion, approve or disapprove a request for a special use of the park pavilions and may attach conditions or restrictions on the event to be met by the applicant as part of any approval.

(c) 
The Recreation Board may require the applicant or organization to pay a table reservation fee or deposit fee in accordance with Subsection B below.

B. 
Table reservation fees; deposits; procedure.
(1) 
A fee of $5 per table shall be charged to any person, group or organization to place a reservation for tables at a park pavilion for their picnic or event.

(a) 
Table reservations shall be made in person at the Borough Office, on a first-come first-served basis, upon payment of the required reservation fee and deposit, if applicable.
(b) 
In addition to the reservation fee, a refundable deposit fee shall be charged to any person, group or organization reserving 10 or more tables at a park pavilion, to guarantee that the pavilion and park facilities are cleaned up after the event and no facilities or equipment are removed, damaged, or rearranged.

The deposit fee shall be refunded to the applicant within 30 days of the event if the pavilion and park facilities, upon inspection immediately after the event, are found to be in acceptable condition. If the inspection reveals that the tables or pavilion are littered, or that park equipment or facilities have not been left in acceptable condition, then the deposit fee shall be retained by the Borough to offset the cost of cleanup and/or repairs, etc.
(c) 
Reservation fees may be refunded due to cancellation only up to three days prior to the date of the reservation. Table reservation fees shall not be refunded after the cancellation deadline date due to weather conditions.
(2) 
The Recreation Board may consider written requests from nonprofit groups or organizations for waiver of the normal table reservation fees for weekday dates (Monday through Friday).
(a) 
There shall be no waiver of table reservation fees for any weekend dates (Saturdays and Sundays), from noontime to closing, from Memorial Day to Labor Day each year, as these are the time periods that are most in demand for family groups, company picnics, etc.
(b) 
Such nonprofit groups or organizations may be asked to make a donation to the Borough in lieu of payment of a table fee in order to offset the costs of providing cleanup services.
C. 
Borough Council may, by resolution, revise or amend the amount or form of the table reservation fee or the policy on waiver of such fees, as stated above.
A. 
Rules and regulations.
(1) 
The Dansbury Park tennis courts shall be used exclusively for the game of tennis. All other uses and activities are strictly prohibited on the tennis courts or in the tennis court area.
(2) 
Borough Council may establish and enforce such other rules and regulations concerning the use of municipal tennis courts as it deems necessary.
A. 
Rules and regulations. The following rules and regulations are hereby established for use of the athletic fields located at Dansbury Park and Zacharias Pond Park:
(1) 
The baseball and soccer fields at Dansbury Park and the multipurpose field at Zacharias Pond Park may be reserved for seasonal use (spring, summer and fall) by area nonprofit youth sports organizations and adult athletic leagues.
(a) 
Spring season: April 1 to mid-June.
(b) 
Summer season: mid-June to August 31.
(c) 
Fall season: mid-August to mid-November.
(2) 
The baseball and soccer fields at Dansbury Park may be reserved for one week only use for special camps or programs by for-profit organizations.
B. 
Field use fees.
(1) 
The following schedule of fees for use of the athletic fields at Borough parks are hereby established:
(a) 
Daily use per season (at least four days per week): $300.
(b) 
Two to three times use per week per season: $200.
(c) 
One time use per week per season: $100.
(d) 
Weekly use, any season (maximum five days): $250.
(2) 
Borough Council may from time to time, by resolution, revise or amend the above schedule of fees.
C. 
Proof of insurance required Organizations applying for seasonal or weekly use of the athletic fields shall be required to provide to the Borough a certificate of insurance evidencing general liability insurance coverage in the minimum amount of $500,000 and naming the Borough as certificate holder and an additional insured. A sample insurance certificate in the form required by the Borough shall be provided to applicants by the Borough.
D. 
Application procedure; permits for field use.
(1) 
Organizations requesting use of the athletic fields shall apply for such use, on forms provided by the Borough, at the Borough Office after January 1 of each year.
(2) 
The Recreation Board shall, at its sole discretion, approve or disapprove such requests for use of the fields and may modify or revise the schedule of use requested as dictated by field availability or other considerations.
(3) 
Permits will be issued by the Borough for approved field uses upon payment of required fees and filing of an approved certificate of insurance.

A. 
Rules and regulations. The following rules and regulations are hereby established for use of the East Stroudsburg municipal (Terra Greens) golf course property and facilities:
(1) 
No person shall be entitled to use the facilities of the East Stroudsburg municipal golf course or be on or about the course without having first registered before each play and having been issued a permit to do so. Such permit shall be evidenced by a receipt showing that the persons or persons using the course have paid the appropriate fees for such use as delineated in this section.
(2) 
No person shall engage in any other sports or games upon the course grounds, including kite flying, model boating, model automobile and model aviation.
(3) 
No person or vehicle shall be on or about the golf course unless the person is a duly authorized player or an officer of employee or the Borough or unless permission has been granted by the Borough Manager or his/her designee for another specific use of the property.
(4) 
No person shall drive or operate any vehicle other than authorized golf carts upon the golf course grounds. The term "authorized golf cart" means only those that are provided by and at the golf course solely for use thereon. Vehicles shall be permitted only upon the driveways, roads, and parking lots of the course.
(5) 
No person shall injure, deface, displace, remove, fill in, raise, destroy or tamper with any part of the course; take up or remove or carry away any sod, stone, gravel, sand, clay, or earth; or make any excavation of any kind; or injure, deface, displace, remove or destroy any structure, building or any other property or equipment, real or personal, owned by or under the jurisdiction or control of the Borough, or appertaining to the creation, government, use or maintenance of said golf course; or injure, or in any way interfere with the operation of any machine or instrument used in said course, or injure, deface, displace, remove or destroy any sign, inscription, post or monument erected for any purpose.
(6) 
No person shall fish upon any of the lands or waters of the golf course without permission of the Borough.
(7) 
No person shall throw, cast or discharge into any of the waters of the golf course any substance, matter or thing, liquid or solid, which may result in the pollution of said waters.

(9) 
A permit for use of the golf course facilities shall authorize the same only insofar as it may be performed in strict accordance with the terms and conditions thereof and these rules and regulations for the golf course. Any violation by its holder of any such terms and conditions or these rules and regulations shall constitute grounds for revocation of the permit by golf course staff. In the event of revocation of any permit, all monies paid for or on account thereof shall be forfeited to and be retained by the Borough, and the holder of such permit together with his agents or employees who violated such terms and conditions or rules and regulations shall be jointly and severally liable to the Borough for all damages and loss suffered by it in excess of the monies so forfeited and retained; but neither such forfeiture and retention by the Borough of the whole or any part of such monies nor the recovery or collection thereof of such damages, or both, shall in any manner relieve such person or persons from liability for punishment for any violation of any provision of this chapter or any other Borough ordinance.
(10) 
Borough Council may, by resolution, revise, add to or amend the above list of rules and regulations.
B. 
Schedule of user fees.
(1) 
Greens fees. The greens fees for playing golf shall be established from time to time by the Borough Manager or his/her designee and shall be posted at the Golf Shoppe.

(2) 
Cart rental fees. The fees for use of a motorized golf course cart or for use of a hand-pull cart shall be established from time to time by the Borough Manager or his/her designee and shall be posted at the Golf Shoppe.
(3) 
Specials. Fees for combination rates for greens fees and cart rental, senior discount rates, and other special rates may be established by the Borough Manager or his/her designee from time to time and such rates shall be posted at the Golf Shoppe.

Annual memberships.

Golfers shall be issued an unlimited permit upon payment of an annual greens fee as follows:

Resident discounts. East Stroudsburg Borough residents shall receive a discount of 10% off all annual membership rates.

C. 
Operating hours. The Borough Manager or his/her designee is hereby authorized to establish, and post at the Golf Shoppe, hours of operation for the golf course, and to vary such hours of operation when circumstances warrant.
A. 
Rules and regulations.
(1) 
Any of the rules and regulations contained in this chapter may be waived by Borough Council upon application to Council for special events at Borough parks or recreation properties or facilities.
Provisions of this chapter shall be enforced by the Stroud Area Regional Police Department and by Borough parking enforcement officers or park security officers, as applicable.
A. 
Any person who violates or who fails to comply with any provision of this chapter, with the exception of a parking violation, shall be liable to pay a fine not exceeding $600 or be sentenced to imprisonment for a term of not more than 30 days, or both, upon conviction before any District Justice.
B. 
Any person who violates or who fails to comply with § 114-2A(11) shall, upon conviction, be sentenced to pay a fine of $30.
