It shall be unlawful for any person or persons to deposit or suffer
to be deposited any debris or material upon the ice or in the water of Harveys
Lake. Any and all debris or material brought upon the ice of Harveys Lake
must be removed on a daily basis.
All fishing shelters shall be constructed of durable material sufficient
to withstand the effect of water and the elements and shall be portable in
nature.
It shall be unlawful for any person or persons to leave any fishing
shelters upon the ice of Harveys Lake when through fishing for the day. Failure
to remove same as required shall permit the proper Borough official to confiscate
and remove the same from the ice.
Any person or persons violating any of the provisions of this chapter
shall, upon conviction thereof for each violation, be subject to a fine of
not more than $100, plus costs of prosecution. In default of the payment of
such fine and costs, such person or persons shall be imprisoned for a period
of not more than 90 days. Each day shall constitute a separate violation.
This chapter is enacted for the specific purpose of regulating the health
and welfare of the Borough. It is in no way intended as an indicator of the
safe or unsafe conditions of the ice. The Borough deems all such use of the
ice of Harveys Lake as hazardous and hereby warns the users thereof that they
do so at their own risk.
