There is hereby established in and for the Township of Westtown
a Bureau of Fire Prevention, hereinafter called "Bureau," which shall
operate under the direct supervision and control of the Board of Supervisors
of Westtown Township, hereinafter called "the Board." Members of the
Bureau shall serve without pay, but may be reimbursed for necessary
and reasonable expenses.
The Bureau shall be responsible for the implementation and enforcement
of the Fire Code[1] and, in pursuance thereof, shall maintain active contact
with all volunteer fire companies active within the geographical limitations
of Westtown Township to assure the proper maintenance of fire prevention
and control within the township. The Bureau shall not expend township
funds without the expressed consent in writing of the Board.
Any person, or persons, appointed by the Board to membership
on the Bureau shall serve a term of two years, upon such terms and
conditions as the Board may from time to time decree.
The Bureau shall render a report to the Board no later than
November 1 of each year, said report to contain a record of all proceedings
by the Bureau in the enforcement and implementation of the Fire Code
during the preceding 12 months. The report may also contain such statistics
as the Bureau may wish to include therein.
If the Board shall fail to appoint members of the Bureau, the
Board shall itself serve as the Bureau and shall delegate such duties
of the Bureau as it may see fit to the Fire Marshal.
The Fire Marshal of Westtown Township, hereinafter called "Fire
Marshal," shall be appointed by the Board upon adoption of this chapter
and shall serve for such period and upon such terms and conditions
as the Board shall direct. The Board may, from time to time, appoint
an assistant or assistants to the Fire Marshal, upon recommendation
of the Bureau, and said assistants shall serve at the pleasure of
the Board. The Fire Marshal and his assistants shall be properly qualified
to perform their duties and shall receive such compensation as the
Board may, from time to time, direct.
The Fire Marshal shall be the chief enforcement officer of the
Township Fire Code and have the power and responsibility of enforcing
the Fire Code.
The Fire Marshal shall be responsible for the preparation and
submission of such fire reports as may be required from time to time
by the Commonwealth of Pennsylvania, or any agency thereof, the County
of Chester, or other governmental bodies or agencies thereof. Additionally,
the Fire Marshal shall report in writing each month to the Board the
conduct of the affairs of his office and shall submit to the Board
such information as it may from time to time prescribe.
Nothing in this chapter or in the BOCA Basic Fire Prevention
Code hereby adopted shall be construed to affect any suit or proceeding
pending in any court, nor shall any just or legal right or remedy
of any character be lost, impaired or affected by this chapter.
