Building construction — See Ch. 57.
A certain document, being marked and designated as the "BOCA National Energy Conservation Code, Seventh Edition, 1993," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Energy Conservation Code of the Township of Westtown in the County of Chester, State of Pennsylvania, for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Energy Conservation Code are hereby referred to, adopted and made a part hereof, as if fully set out in this chapter, with the additions, insertions and changes, if any, prescribed in § 77-2 of this chapter.
A. 
The Pennsylvania State Building Energy Conservation Act 222, as amended by Act 98 of 1985 and administered by Westtown Township for Use Group R residential buildings, is hereby added in its entirety and becomes the required standard for Use Group R structures.
B. 
Section E-101.5 is added to read as follows:
Any person who violates or permits a violation of this code shall, upon conviction in a summary proceeding brought before a District Justice under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this code that is violated shall also constitute a separate offense.
Nothing in this chapter or in the Energy Conservation Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or cause of action acquired or existing under any act or ordinance hereby repealed, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
