It is hereby declared that the health, comfort,
convenience, safety and welfare of the citizens of the City of Monroe
require the establishment and implementation of certain controls applicable
to animals kept within the City or which stray within the City, in
order to prevent such animals from making disturbingly loud noises
and from roaming outside the boundaries of the owner's property unless
properly restrained by the owner or the owner's designee.

As used in this chapter, unless the context
requires a different meaning:
ANIMAL
Any dog or other mammal, any domestic bird or reptile, and
includes any exotic, wild or otherwise dangerous animal.
OWNER
When applied to any property or premises, means both the
owner of the title of record and any person occupying or in possession
of such property or premises. "Owner," when applied to the proprietorship
of any animal, means any person having a right of property in the
animal and any person who harbors, cares for or exercises control
over such animal or knowingly permits the animal to remain on or about
any premises occupied by that person.
ROAMING ANIMAL
Any animal which is not physically restrained or otherwise
under the physical control of the owner or his or her designee so
that it is kept from going onto another's premises without permission.

A. Animal noise. No person shall own, keep, harbor or
have possession of any animal which, by frequent or habitual howling,
barking or other noise, shall disturb the quiet, comfort or repose
of any person. The sounds shall be of such a level that they can be
reasonably assumed to create an intrusion into the public peace or
to be of actual physical discomfort to persons of ordinary sensibilities.
B. Running at large; trespass; property destruction.
No animal owner or owner's designee shall permit any animal to be
at large or to stray beyond the property of such person, unless such
animal is restrained by a leash and is accompanied by an owner or
owner's designee. No animal owner or owner's designee shall permit
any animal to trespass upon the property of another person or to cause
damage to the property, real or personal, of another person.
C. A violation of this section is a municipal civil infraction and shall subject the violator to the penalties provided in §
1-27E of the Code of the City of Monroe. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.

A. It shall be unlawful for any person owning, possessing,
keeping, or in charge of any animal to cause, allow, permit or suffer
said animal to deposit fecal matter ("animal waste droppings") on
any public street, sidewalk, play area, park, or upon any public property
whatsoever, or upon any private property without permission of the
owner of said private property unless such fecal matter ("animal waste
droppings") is immediately removed and disposed of in a sanitary manner
by the person who so owns, possesses, keeps, or is in charge of said
animal.
B. A violation of this section is a municipal civil infraction and shall subject the violator to the penalties provided in §
1-27E of this Code of the City of Monroe. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
