A. Plan review fees.
(1) When construction documents are submitted for review by the Code Enforcement Officer, a plan review fee of $25 shall be paid at the time of submitting the construction documents for plan review. (NOTE: See §
67-19A, Plan review fees.)
(2) Exception.
There shall be no plan review fee for plan review of agricultural
structures, one- or two-family dwellings (not including townhouses),
mobile or modular homes, house trailers, or accessory structures associated
with residential uses.
B. Permit fees. Fees for building permits and operating
permits shall be as set forth in Table 190-79, and shall be paid before
the permit is issued. Where fees are based on square footage, the
fee shall be calculated by the gross square footage of all floor areas,
excluding unfinished basements and unfinished attics.

C. Multiple types of work. In a case where a permit is
applied for more than one category of work, the permit fee shall be
that which is the highest for any one category of work involved, except
that separate permits (or cumulative fees) shall be required for each
of the following types of work:
(1) Solid fuel-burning appliances.
(2) Demolition or removal of an entire structure.
(3) Swimming pools, hot tubs and spas.
(4) Telecommunication towers.
(5) Wind energy conversion systems.
(6) Gas or oil well drilling.
D. Unauthorized construction. Where work has commenced
before issuance of a building permit, there shall be a surcharge equal
to the minimum permit fee imposed. Where more than one category of
work is involved, the surcharge shall be the highest minimum fee for
any one category.
E. Truss-type construction. Prior to issuance of a building
of truss-type construction, there shall be paid additional fee of
$50 for enforcement of Part 1264 of Title 19 of the New York Code
of Rules and Regulations.
F. Variances and special permits. Fees for variances
and special permits shall be as follows, except where specifically
stipulated elsewhere in this chapter:
(1) The application fee for an area variance shall be
$50.
(2) The application fee for a temporary or special permit
shall be $75.
(3) The application fee for a use variance shall be $75.
(4) There shall be no application fee for an appeal to
the Zoning Board of Appeals for an interpretation only.
(5) Where an applicant is requesting more than one type
of approval, each shall be considered a separate appeal and shall
require a separate application fee.
G. Site plan review. All applications for site plan review
shall be accompanied by a fee of $25, in addition to all other fees.
H. Inspection fees. Inspection fees are established as
follows, and shall be in addition to all other required fees:
(1) The fee for inspection of one- and two-family residential
buildings shall be $20 per dwelling unit.
(2) The fee for inspection of multifamily residential
buildings shall be $20 per dwelling unit and/or $10 per rooming unit.
(3) The fee for inspection of nonresidential buildings
and facilities shall be $25 per building and/or tenant space.
(4) The fee for a reinspection without compliance shall
be the same rate as the original fee.
I. Property maintenance inspections.
(1) A "property maintenance inspection" shall be defined
as an inspection made either in response to a complaint, or at the
Code Enforcement Officer's own initiative, which reveals a violation
of the New York State Uniform Fire Prevention and Building Code, this
chapter, the Village of Clyde Municipal Code, or New York State Multiple
Residence Law.
(2) There shall be no fee for an initial property maintenance
inspection.
(3) There
shall be a fee of $25 for each subsequent property maintenance inspection
that reveals noncompliance after an order to remedy has been properly
served in accordance with applicable laws and regulations.
J. Inspection of abandoned property.
(1) "Abandoned property" shall be defined as a vacant
building or portion thereof that: i) is not sealed or continuously
guarded as required by law, or was sealed or is continuously guarded
by a person other than the owner, a mortgagee, lienor or agent thereof;
or ii) contains accumulations of combustible materials, flammable
or combustible waste or rubbish, or hazardous materials; or iii) is
not provided with operable fire alarm, sprinkler or standpipe systems
as required by law; and either of the following facts exist:
(a)
A vacate order of the Village or other governmental
agency currently prohibits occupancy of the building; or
(b)
The tax on such premises has been due and unpaid
for a period of at least one year.
(2) The fee for inspection of abandoned property shall
be $100.
