Ord. No. 17:8-30, adopted 9-4-1930
Section 1. Public necessity and the general welfare of the inhabitants of the Township of Chester no longer require the section of public road hereinafter particularly described, and the continued maintenance thereof is a useless public burden.
Section 2. The section of public road in the said Township of Chester, in the County of Morris, abutted southerly by lands of William B. Hardin and northerly by lands of John R. Hardin and John R. Hardin, Junior, between the Chester-Gladstone County Road and the new State Highway, Route 31, from Gladstone to Chester, is hereby vacated and the public's rights therein extinguished, and the land comprised therein is reverted and restored to the abutting owners respectively on either side, freed and discharged from all public rights as if such public rights had never existed.
Section 3. This ordinance shall become effective immediately.
Section 1. Public necessity and the general welfare of the inhabitants of the Township of Chester, in the County of Morris, no longer require the section of the public road known as the "Pottersville Road," hereinafter particularly described as at present located, and it will be in the public interest and to the public advantage to relocate the same, as hereinafter specifically described, so as to assure a direct junction with the new State Highway Route 31.
Section 2. The section of the public road in the Township of Chester, in the County of Morris, known as the "Pottersville Road," from its junction at its eastern outlet with the Chester-Gladstone County Road, at Hardin's Corner, through lands of John R. Hardin and Hendon Chubb to the intersection of said road by the dividing line between lands of Hendon Chubb and A. G. Kay, a distance of about 7/8 of a mile, is hereby vacated as a public road and highway, and the public's rights therein are extinguished and the lands therein comprised are reverted and restored to the abutting owners respectively, freed and discharged from all public rights as if such public rights had never existed.
Section 3. This ordinance shall become effective when and after the aforesaid John R. Hardin and Hendon Chubb: (1) shall dedicate or cause to be dedicated to public use for highway purposes, a new right-of-way, two rods in width, from the aforesaid dividing line between lands of Hendon Chubb and A. G. Kay, in continuation of said Pottersville Road easterly from that line, and in lieu of the section of said road hereby vacated, in a substantially direct line, across lands of said Hendon Chubb and John R. Hardin to the aforesaid Chester-Gladstone County Road slightly northerly of the point where the dividing line between lands of said John R. Hardin and J. Brooks Nichols meets the said County Road, and continuing thence across said County Road across land of William B. Hardin to a junction with the new State Highway Route 31, from Gladstone to Chester: and (2) shall build or cause to be built, on the said dedicated new right-of-way, a new road, with a travel surface of 16 feet in width with necessary provisions for drainage, said new road to be practically equivalent in suitability for public use to the road hereby vacated.
Section 1. Public necessity and the general welfare of the inhabitants of the Township of Chester no longer require a certain portion of a public road hereinafter described.
Section 2. Said portion of the public road hereinafter described is considered and deemed unsuited and undesirable for such public use and otherwise useless, burdensome and disadvantageous to the public.
Section 3. The portion of a public road hereinafter described shall be vacated and the public's rights therein be extinguished and said land revert to and be restored to the holder or holders of the legal fee thereof, freed and discharged from all public rights, as if such public rights had never existed.
Section 4. The land and premises to be vacated are described as follows: A portion of the public road running from Masonic Farm to Union Grove beginning at the westerly line of the new State Highway Route No. 31 extending westerly and southwesterly to the above-mentioned State Highway abutted by the lands of Jay Coogan and Julia A. Bradley.
Section 5. This ordinance shall become effective immediately upon and after its passage.
Section 6. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
Ord. No. 17:7-37.
Section 1. The portion of the public road hereinafter described shall be vacated and the public's rights therein shall be extinguished and said land referred to shall be restored to the holder or holders of the legal fee thereof freed and discharged from all public rights as if such public rights had never existed.
Section 2. The land and premises to be affected are described as follows: A portion of the public road running from Hacklebarney to Chester, beginning at the northeasterly right-of-way line of the Hacklebarney Park Road which runs from Milldale southerly to the Hacklebarney State Park entrance, said beginning point being approximately opposite station 35 plus 20 and said beginning point being immediately west of the bridge over Black River and extending in a general northeasterly direction across Black River and along said Hacklebarney to Chester Road to the 5th. course in a deed given by WoWanda Realty Company to Frank Wilk dated April 22, 1935, and recorded in the Morris County Clerk's Office in Book Z-33, pages 205 &c. of Deeds abutted by lands of Adolph E. Borie.
Section 3. This ordinance shall become effective immediately upon and after its passage.
Section 4. All ordinances or parts of ordinances inconsistent herewith are hereby repealed
Ord. No. 2:1-44, adopted 7-6-1944.
1. A certain strip of land lying on the south side of the street, commonly known as "Factory Street," which was set off by a certain Road Return, dated October 27, 1868, and recorded in the Morris County Clerk's office in Book D of Roads on pages 119, which land has never been used by the Township of Chester as a public road, as to so much thereof as is hereinafter particularly described, that any public right that may have arisen by dedication or otherwise be hereby released and extinguished.
Description: Beginning at a rail monument set on the easterly side line of Hillside Road, said monument marks the point formed by the intersection of said side line and the division line between lands of Dora Sturzenegger and lands of the heirs of William Sturzenegger and lands formerly of the Chester Railroad Company, now of Harry W. Cyphers and John Holthusen, and running thence (1) along said division line North 66 degrees East 850 feet more or less to the westerly side line of the public road leading from lands of John Holthusen to the road leading from Chester to Flanders; thence (2) along the westerly side line of said public road in a southeasterly direction 25 feet more or less; thence (3) parallel to the first course hereof and 25 feet distant more or less as measured at right angles therefrom, South 66 degrees West 860 feet more or less to a point in the easterly side line of Hillside Road; thence (4) along said easterly side line of Hillside Road in a northwesterly direction 25 feet more or less to the point or place of beginning.

Section 1. Public necessity and the general welfare of the inhabitants of the Township of Chester no longer require a certain portion of a public road hereinafter described.
Section 2. Said portion of the public road hereinafter described is considered and deemed unsuited and undesirable for such public use and otherwise useless, burdensome and disadvantageous to the public.
Section 3. The portion of a public road hereinafter described shall be vacated and the public's rights therein shall be extinguished and said land shall revert to and be restored to the holder or holders of the legal fee thereof, freed and discharged from all public rights, if such public rights had never existed.
Section 4. The land and premises to be vacated are described as follows: Beginning at a point known as "Call's corner" and running in a general direction towards Bartley and from said point running through the lands and premises now or lately William Rockefeller and Francis Frost to a point where the road hereby intended to be vacated intersects the new State Highway.
Section 5. This ordinance shall become effective immediately upon and after its passage.
Section 6. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
Ord. No. 17:10-50, adopted 11-16-1950.
1. A certain portion of Parker Road as to so much thereof as is hereinafter more particularly described shall be vacated, and the public rights therein shall be released and extinguished.
2. The lands and premises to be vacated are described as follows:
All that certain tract or parcel of land lying and being in the Township of Chester, County of Morris and State of New Jersey.
The center line of the road to be vacated is described as follows:
Beginning at a point in the center line of the old portion of Parker Road in the center of the old bridge crossing the brook dividing the Township of Washington and the Township of Chester and running along the center line of the old portion of Parker Road in a northerly and northeasterly direction 710 feet, more or less, to a point in the northwesterly side of a strip of land 50 feet in width conveyed by Kathryn B. Prudden and Harris C. Prudden to Township of Chester by deed dated December 23, 1946, and recorded in the Morris County Clerk's office in Book K-42 of Deeds, pages 249 &c.
It is intended hereby to vacate the above-described road on both sides of the above-described center line to the full width thereof.
3. This ordinance shall take effect as provided by law.
Ord. No. 17:11-51, adopted 6-7-1951.
1. Part of the old road leading from Chester to Bartley, dedicated as a public street as to so much thereof as is hereinafter described, any public right which may have arisen from said dedication or otherwise, shall be released and extinguished:
All that part of the old road leading from Chester to Bartley, lying on the northerly side of Oakdale Road and east of Hillside Road, thence running in a northerly direction through the property of Edwin H. Hann to the northerly boundary line of his land, which tract is more fully described in the Morris County Clerk's office in Book Z-41 of Deeds on pages 399 &c.
2. This ordinance shall take effect as provided by law.
Ord. No. 17:12-53, adopted 2-5-1953.
1. That part of Fox Chase Road dedicated as a public street as to so much thereof as set forth and shaded on the map attached hereto and made a part hereof,[1] any public right which may have arisen from said dedication or otherwise, shall be released and extinguished.
2. This ordinance shall take effect as provided by law.
Ord. No. 17:13-53, adopted 2-5-1953.
1. That part of the road known and designated as "Old Road to Hackelbarney" dedicated as a public street as to so much thereof as is hereafter described, the public right arising from said dedication or otherwise shall be released and extinguished: Beginning at the line of division of property of the Willmen Co. and Alfred G. Kay and running the various courses and distances thereof to the point of intersection of the Old Road to Hackelbarney with the Old Road to Washington Turnpike.
2. That part of the road known and designated as "Old Road to Washington Turnpike" dedicated as a public street as to so much thereof as is hereafter described, the public right arising from said dedication or otherwise shall be released and extinguished: Beginning at a point in Route #24 at or near the most northwesterly corner therein of property conveyed by Lyman A. Zeek to Sara Stone, thence in a general southerly direction across said Stone property and over property formerly of Horten, now Stone, 18 chains more or less to a point where the same intersects the old road from Chester to Hackelbarney, known as "Old Road to Hackelbarney," now through property of Willmen Company.
3. This ordinance shall take effect as provided by law.
Ord. No. 17:14-57, adopted 3-4-1957.
1. That road or street dedicated as a public street, hereinafter described, any public right which may have arisen from said dedication or otherwise, shall be released and extinguished: Beginning at a point, said point being on the southeasterly side of Cliffwood Road and 825 feet from the center line of Route 24, thence South 28 degrees 34 minutes East 600 feet to a point, thence (2) South 61 degrees 26 minutes West 50 feet, thence (3) North 28 degrees 34 minutes West 600 feet, thence (4) North 61 degrees 26 minutes East 50 feet to the point and place of beginning.
2. This ordinance shall take effect as provided by law.
Ord. No. 17:15-59, adopted 6-1-1959.
The public rights arising from the aforesaid dedication of River Road and Chestnut Street, South of Ironia Road, as shown on the aforesaid map and on the copy of a portion of said map attached hereto, including all lands lying within the boundaries of said River Road and Chestnut Street, South of Ironia Road, be and the same are hereby released, extinguished and vacated, and the said lands be and are hereby discharged from the public rights arising from said dedication as though the dedication thereof had not taken place. This ordinance shall take effect upon final adoption and publication thereof as provided by law.

The streets or roads hereinafter set forth were laid out upon a map but were never opened or constructed and are what are commonly known as "paper streets."
The streets or roads as designated on a map attached to a Deed dated September 28, 1929, and recorded in the Morris County Clerk's office in Book A 32 of Deeds, pages 34 etc., entitled, "A map of property belonging to William G. Nash, Chester Township, Morris County New Jersey," prepared by Frederick Smith, C. E. and described as follows are hereby vacated:
A street or road 50 feet in width running in a southwesterly direction starting at Route #24 between lots 4 and 5 and running 600 feet southeasterly from and parallel to Cliffwood Road for a distance of 4,145 feet more or less to the outside line of the whole tract.
A street or road 50 feet in width running at right angles to Cliffwood Road and along the northeasterly side of lots 110 and 111 a distance of 600 feet more or less.
A street or road 50 feet in width running at right angles to Cliffwood Road and along the northeasterly side of lots 101 and 120 a distance of 600 feet more or less.
A street or road 50 feet in width and running at right angles to Cliffwood Road and along the northeasterly side of lots 87 and 132 a distance of 600 feet more or less.
A street or road 50 feet in width and starting at the outside line of the whole tract and the northwesterly side of lot 188 and continuing in a southwesterly direction 1,855 feet more or less to the outside line of the whole tract.
A street or road 50 feet in width together with curves at each end and running on the northeasterly side of lots 147 and 160 a distance of 800 feet more or less.
A street or road 50 feet in width together with curves at each end and running on the southerly side of lots 135, 136 and 165 a distance of 1,050 feet more or less.
A street or road 25 feet in width running on the southwesterly side of lots 14 through 17 a distance of 695 feet more or less.
It being the intention to vacate all the streets or roads shown on the first above referred to map, except the road known as "Cliffwood Road."
Ord. No. 17:17-66, adopted 2-7-1966.
1. All the public rights, privileges and right-of-way in and to that portion of the public street, highway or right-of-way which was referred to as a proposed street to be known as "Ann Lane" in deeds of conveyance from Lillian Greenhut and Abraham Greenhut, her husband, to Simon Tannenbaum and Ida Tannenbaum, his wife, and recorded in Deed Book P-51, pages 165 and 301, and from Lillian Greenhut and Abraham Greenhut, her husband, to Ben Schames and Gertrude Schames, his wife, recorded in Deed Book P-51, page 327, in the Morris County Clerk's office, which Ann Lane as it was then proposed would now be located within the boundary lines of property presently known and designated on the Tax Map of the Township of Chester as Lots 168, 169, 170, 171 in Block 33, be and the same is hereby vacated as and for a public street, highway or right-of-way.
2. This ordinance shall take effect as provided by law.
Ord. No. 2:3-66, adopted 6-6-1966.
1. All the public rights, privileges and right-of-way in and to the lane or driftway running from Parker Road across lands of Buck Hill Development Co., Inc., John Van Deursen, Ernest A. Nielsen, Edmund T. Stubbe and Richard F. Nabbe to Hackelbarney Road be and the same are hereby vacated, and said lane or driftway is hereby vacated as and for a public road, street, right-of-way or highway.
2. This ordinance shall take effect as provided by law.
Ord. No. 17:18-68, adopted 3-4-1968.
A portion of the old right-of-way of Four Bridges Road as hereinafter described be and the same is hereby vacated, and any and all public rights therein be and the same are hereby released and extinguished:
All the land lying between the old easterly right-of-way line and the new easterly right-of-way line as shown on map of Four Bridges Road, Section No. 1, Chester Township, Morris County, New Jersey, dated November 15, 1961, and on file in the Township Clerk's office, same being 25.00 feet measured at right angles from the new center line, and from thence runs parallel and distant 25.00 feet easterly from the new center line being Station 35 + 71, (1) along the center line South 65 degrees 43 minutes 30 seconds East 93.51 feet to Station 36 + 64.51 to the point of curve, thence (2) still along the center line and on a curve to the right having a radius of 764.49 feet, a distance of 504.25 feet to the point of tangency being Station 41 + 68.76, thence (3) still along the center line South 27 degrees 56 minutes East 37.81 feet to Station 42 + 06.57 the point of curve, thence (4) still along the center line on a curve to the left having a radius of 459.28 feet for a distance of approximately 150.00 feet on the easterly side to Station 43 + 57 on the easterly right-of-way and that portion on West between the old and new right-of-way from Station 43 + 53 on the westerly right-of-way approximately 136 feet to Station 44 + 89 the intersection of the northerly right-of-way line of Tanners Brook Road.
It being the intent to vacate only that portion lying east and west of the new fifty-foot right-of-way, being 25.00 feet on each side of the new center line, and the new right-of-way lines to be the abutting property's new property line.
Ord. No. 17:30-68, adopted 2-5-1968.
1. A proposed street dedicated as a public street as to so much thereof as is hereinafter described, any public right which may have arisen from said dedication or otherwise, shall be released and extinguished.
All that certain proposed street or road along Four Bridges Road together with a fifty-foot road with cul-de-sac as shown on a map of Kyle A. Lunger and Esther R. Lunger as prepared by office of Leslie M. Apgar, Licensed Engineers and Surveyors, dated December 1951 and any revised map to the same. Said property being now owned by James B. Thomson and Ruth Thomson, his wife.
Ord. No. 17:19-70, adopted 5-4-1970.
1. The public interest will be better served by releasing from dedication the following streets and roads:
A. Hazel Road from intersection of Ironia Road, 1545 feet more or less to end of street.
B. Oak Street at a point on north side of Ironia Road, 646 feet more or less to Township line.
C. Chestnut Street at a point on the north side of Ironia Road, 860 feet more or less to the Township line.
D. Jefferson Street at a point 226 feet from north side of Ironia Road extending 900 feet more or less to the Township line.
E. Wilson Avenue from intersection of Golf Course Road, 630 feet more or less to Jefferson Street.
F. Wilson Avenue at a point 600 feet from the easterly side of Jefferson Street, 780 feet more or less to the Township line.
G. Richards Avenue in a straight line 210 feet from the center of Golf Course Road, 1,998 feet more or less to the Township line.
H. Maple Avenue in a straight line 270 feet from the center of Golf Course Road, 1460 feet more or less to the Township line.
I. Elm Avenue in a straight line 335 feet from the center of Golf Course Road, 890 feet more or less to the Township line.
J. Old Hacklebarney Road from intersection of Route 24, 1,865 feet more or less to the end of the road.
2. The public rights in said streets and roads be extinguished and that the same be and they are hereby vacated.
3. This ordinance shall take effect as provided by law.

1. All that tract or parcel of land and premises situate, lying and being in the Township of Chester, County of Morris and State of New Jersey, being described as follows:
Being that certain fifty-foot wide right-of-way as R.O.W. for Future Road on a certain map entitled "Final Plat -
Section No. 3 of Twinbrooks, Township of Chester, Morris County, New Jersey," scale one inch equals 100 feet, dated August 28, 1978, signed by D. Gregg Williamson, P.E. 9 L.S., Pluymers, Williamson and Barbieri, Mendham, New Jersey. which map was filed in the Morris County Clerk's office on December 4, 1978, as Map No. 3759.
Said right-of-way having been divided along the center line thereof and being further described as follows:
PARCEL I
Beginning at a point in the northerly side line of a public road known as "Twinbrooks Trail," where said side line is intersected by a curve connecting the easterly side line of a fifty-foot right-of-way for future road to said northerly side line of Twinbrooks Trail, as shown on map entitled "Final Plat Section No. 3 of Twinbrooks" filed as Map No. 3759; from said beginning point running thence the following two courses along the easterly side line of the 50-foot right-of-way and along the westerly line of Lot 1, Block 26-9, lands of George N. Zacsek.
1. In a southwesterly, westerly, then northwesterly direction along a curve to the right, having a radius of 25.00 feet subtending a central angle of 98° 05 30 an arc length of 42.80 feet to a point of tangency; thence
2. North 28° 20 00 West 408.19 feet to a point marking the northeasterly end of said right-of-way, said point also marking the existing northwesterly corner of lands of said Zacsek: thence
3. Along the northerly side line of said right-of-way South 61° 40 00 West 25.00 feet to a point in the center line of said right-of-way; thence
4. Along said center line South 28° 20 00 East 440.56 feet to a point in the aforementioned northerly side line of Twinbrooks Trail; thence
5. Along said side line North 53° 34 30 East 54.06 feet to the point and place of Beginning.
Containing 0.256 acres of land.
PARCEL II
Beginning at a point in the northerly side line of a public road known as "Twinbrooks Trail," where said side line is intersected by a curve connecting the westerly side line of a fifty-foot wide right-of-way for future road to said northerly side line of Twinbrooks Trail, which is shown on Final Plat Section No. 3 of Twinbrooks, filed as Map No. 3759; thence running along said westerly side line of the fifty-foot right-of-way (1) on a curve to the left in a northerly direction having a radius of 25.00 feet and an arc length of 35.74 feet to a point of tangency; thence (2) North 28° 20 00 West 422.41 feet to a point and end of said right-of-way; thence (3) North 61° 40 00 East 25.00 feet to a point in the center line of said right-of-way; thence (4) running in said center line South 28° 20 00 East, 440.56 feet to a point in the northerly side line of Twinbrooks Trail; thence (5) along said side line South 53° 3430 West, 46.95 feet to the point and place of beginning.
Containing 0.256 acres of land, be and the same is hereby vacated as a public street, road or highway and that the public rights and interest therein arising from any dedication thereof being and the same are hereby released and extinguished. It being the intention of this vacation ordinance to vacate the above-described right-of-way as shown on the above-mentioned subdivision map, subject to the restrictions contained in the resolution of the Township of Chester entered September 15, 1981, that the aforementioned property not be improved upon by the construction of any roadway, bikeway or footpath, building or other structure thereon.
2. This ordinance shall take effect upon final passage and publication in accordance with law.
Ord. No. 17:40-82, adopted 11-15-1982.
1. All the tract or parcel of land and premises situate, lying and being in the Township of Chester, County of Morris, State of New Jersey, more particularly described as follows: all of the easements for future road shown on Final Plat of Chester Acres, Chester Township, Morris County, New Jersey, prepared by Associated Consultants, dated January 3, 1978 and filed in the Morris County Clerk's office on June 14, 1979, as Map No. 3819, and further designated by the cross hatched area on the drawing together with all slope right easements in connection with the easement for future road; said easements situate and lying between the northwesterly side line of Rock Spring Road and the westerly side line of Lots 32-11 and 32-12 as shown on said filed map, be and same is hereby vacated as a public street, road or highway, and the public's rights and interest therein arising from any dedication thereof be and the same are hereby released and extinguished. It being the intention of this vacation ordinance to vacate the above-described easement for future road and slope right easements as shown on the above-mentioned final plat of Chester Acres dated January 3, 1978.
2. This ordinance shall take effect upon final passage and publication in accordance with law.
Ord. No. 17:43-83, adopted 7-18-1983.
1. All that portion of the right-of-way off Catan Drive, described as follows:
Beginning at a point in the southwesterly side line of Catan Drive (50 feet wide), said point being distant 25 feet northwesterly from the intersection of said southwesterly side line of Catan Drive with the northwesterly side line of Morlisi Place (50 feet wide) if both side lines were extended to meet and from said point of beginning running thence (1) on a curve to the right having a radius of 25.00 feet an arc length of 39.27 feet to a point of tangency in the northwesterly side line of Morlisi Place; thence (2) along said northwesterly side line of Morlisi Place South 57 degrees 50 minutes 41 seconds West 236.95 feet to a point, being the most southerly corner of Lot 1, Block 51 B as shown on a certain map entitled "Subdivision Section Two for Morand-Puglisi. Inc.," which map was flied in the Morris County Clerk's office July 27, 1965, as Map No. 2593; thence (3) along the southwesterly terminus of said Morlisi Place, south 26 degrees 27 minutes east 50 feet to the southeasterly side line of Morlisi Place and the most westerly corner of Lot 7 in Block 51A as shown on the above-referenced filed map; thence (4) along said southeasterly side line of Morlisi Place north 57 degrees 50 minutes 41 seconds east 241.94 feet 10 a point of curvature; thence (5) on a curve to the right having a radius of 25 feet an arc length of 39.27 feet to a point of tangency in the southwesterly side line of Catan Drive; thence (6) by a new line north 32 degrees 09 minutes 19 seconds west 100.00 feet to the point and place of beginning.
Said description being intended to describe that portion of Morlisi Place (a fifty-foot right-of-way) lying southwesterly of Catan Drive.
Be and the same is hereby vacated as a public street, road or highway, and the public rights and interest therein arising from any dedication thereof be and the same are hereby released and extinguished. It being the intention of this vacation ordinance to vacate the above-described portion of the right-of-way as shown on the above-mentioned subdivision map, subject to a fifteen-foot drainage easement as shown on recorded map entitled "Subdivision Section 2 for Morand-Puglisi, Inc." filed July 27, 1965, in the Morris County Clerk's office as Map Number 2593, which drainage easement shall remain in full force and effect.
2. This ordinance shall take effect upon final passage and publication in accordance with law.
1. There was a previous road right-of-way dedication and acceptance of a portion of Pottersville Road between Old Chester-Gladstone and Route 206, by and between the Township of Chester and K.Hovnanian at Chester I, LLC. A deed of conveyance for the road right-of-way was dated November 4, 2002, and filed in the Morris County Clerk's office on November 15, 2002, in Deed Book 05737, at Page 245.
2. The Township of Chester, subsequent to the right-of-way dedication and acceptance, acquired title to lands directly contiguous to the entire right-of-way.
3. The Township of Chester hereby vacates the road right-of-way, which area of the right-of-way becomes part of Block 14, Lot 1, which is owned by the Township.

1. This ordinance is being adopted pursuant to N.J.S.A. 40:60-28.
The right-of-way is located in a development known as Applewood Farms. It adjoins on four sides Winding Way, a municipal street, Lot 75 and Lot 76 all in Block 26.01, as shown on the official tax map of the Township of Chester. The right-of-way is more particularly described as:
Beginning at the northerly border of Lot 18.01 and extending to the easterly sideline of the road known as Winding Way with a width of 50 feet and a length of 410 lineal along the borders of Lots 75 and 76, Block 26.01.
2. The said right-of-way is no longer needed for public use, is unsuited as a public right-of-way, and is undesirable for such use based on the action taken by the Township's Planning Board on said Subdivision.
3. The Township hereby vacates and releases the public rights in the right-of-way, subject to the terms set forth herein.
4. The Mayor or her representative is authorized to offer the right-of-way for sale to the owners of Lots 18.01, 75 and 76 in Block 26.01 for a price not less than $30,800. The sale is to be at public auction.
5. If none of the said adjoining properties purchases the right-of-way prior to December 31, 2018, the right-of-way shall remain a public right-of-way and shall not be vacated or released.
6. Any provisions of this ordinance of the Township of Chester which are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
7. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this ordinance.
8. This ordinance shall take effect as provided by law.

"scale of one inch equals 100 feet, dated June 8, 1978, signed by Frank W. Dufford, P.E. & L.S., Succasunna, N.J., which map was filed in the Morris County Clerk's office on August 8, 1978, as Map No. 3724, including a cul-de-sac having a sixty-five-foot radius and the arcs and radii connecting thereto;
Also being twenty-foot-wide drainage easements on Lot 5-1, Lot 5-2 and Lot 5-3 in Block 48-1 as shown on said filed map;
Together with all of the surface and subsurface improvements and facilities installed or constructed upon or in the beds of the aforesaid street and drainage easements.

Also being fifteen thirty-foot-wide drainage easements with the right to discharge stormwater on various lots as shown on said filed map.

Roadway dedication: The street known as "Ryan Court" as shown on a certain map entitled "Final Map, Beacon Hill, Section III, Chester Township, Morris County, New Jersey," dated September 17, 1985, prepared by A. a. Chester Township, its agents, employees and representatives shall have the right to enter the land described in these conservation easements for the purpose of making periodic inspections.
b. Chester Township, its agents, employees and representatives shall have the right to enter the land described in these conservation easements for the purpose of conducting geodetic and ecological studies.
c. Custom Living Homes, Inc., its successors and assigns, shall not change any feature of natural landscape or general topography or remove any living trees, shrubs or other vegetation in these conservation easements without the express written approval of Chester Township.
d. Custom Living Homes, Inc., its successors and assigns, will not make any changes to the premises described in these conservation easements that will be adverse to existing drainage, flood control, erosion control or soil conservation without the express written approval of Chester Township.
e. Custom Living Homes, Inc., it successors and assigns, shall not deposit any trash, wastes or other unsightly or offensive materials upon the premises described in these conservation easements nor use the same for storage of materials that will adversely affect the scenic beauty of said premises.
f. No advertising of any kind or nature shall be located on or within the premises described in these conservation easements without the express written approval of Chester Township except for Custom Living Homes, Inc.'s advertisements to sell the subject dwelling units in Beacon Hill. This shall not prohibit the placing of a sign at the entranceway setting forth the name of the development.
g. No structures of any kind shall be placed or erected upon the premises described in these conservation easements unless application therefor with plans and specifications of any such structures have been filed with and expressly approved by Chester Township. Existing roads, driveways and utility lines along or across the premises described in these conservation easements and those contemplated for the construction of Beacon Hill by Custom Living Homes, Inc., may be continued and repaired as required; however, said facilities shall not be relocated nor shall any new roads, driveways or utility lines be constructed or erected without express written approval of Chester Township.
h. The subject conservation easements are binding upon Custom Living Homes, Inc. and its successors in interest.
Section 4. Drainage easement: Drainage easements across Block 7, Lots 12.12, 12.14, 12.15, 12.16, 12.17, 12.18, 12.19, 12.20, 12.21 and 12.33 as set forth on the aforementioned Final Map on the following terms and conditions:
a. Chester Township shall have the right to discharge stormwater runoff along and through any pipes constructed in said easements together with the right of open discharge of stormwater into said easements.
b. No buildings or other structures shall be erected or placed within the drainage easements except by mutual agreement of Custom Living Homes, Inc., its successors and assigns, and Chester Township, and no other activity shall be permitted within the drainage easements which would or might be detrimental to stormwater drainage or any other purpose for which these easements are created.
c. Chester Township, its agents, employees and representatives shall be permitted access to and entry upon the drainage easements hereby conveyed at all reasonable times upon timely notice to Custom Living Homes. Inc., its successors and assigns, but solely for the purpose of inspection, protection and maintenance.

Section 1. The Township of Chester hereby accepts as municipal roads of the Township of Chester Walnut Hill Drive and Hickory Drive to the limits of the Walnut Hill Subdivision for Section I and Section II as shown on the plat filed with the Township of Chester.
Section 2. The Township of Chester hereby waives the requirement of a maintenance bond for the aforesaid roads and hereby releases the performance guarantees heretofore posted.
Section 3. This ordinance shall take effect as provided by law.

Section 1. Willow Drive, Robin Court and Chestnut Drive, roads in the Township of Chester, County of Morris, State of New Jersey, in a subdivision known as "Chestnut Run" are hereby accepted as municipal roads in the Township of Chester.
Section 2. The bond previously posted for the completion of the said roads is hereby released.
Section 3. This ordinance shall take effect as provided by law.

Section 1. The Township of Chester hereby accepts as municipal roads of the Township of Chester Winding Way, and extensions of Parks Lane, and Forest View Drive and all drainage improvements, rights-of-ways, and easements as being shown on a map entitled "Final Plat, Applewood Farms, Township of Chester, Morris County, New Jersey," dated March 9, 1988, prepared by Pluymers, Williamson & Associates, Inc., revised August 3, 1988, which map was recorded in the Office of the Clerk of Morris County on September 29, 1988, as Map No. 4703.
Section 2. The Township of Chester hereby establishes the requirement of a two-year maintenance bond for the aforesaid roads and improvements in the amount of $61,492.37 and hereby releases the performance guaranties heretofore posted.
Section 3. This ordinance shall take effect as provided by law.

Section 1. The Township of Chester hereby accepts as a municipal road of the Township of Chester a street known as "Cedar Ridge Drive" located in the subdivision known as "Cedar Ridge Subdivision" as shown on the filed subdivision plat for the subdivision.
Section 2. This ordinance of acceptance is contingent upon the posting a maintenance bond in the amount of $11,414.32 to all material and workmanship for a period of two years date of acceptance.

The said streets are shown on a certain map entitled "Final Map of South Gables, Block 32, Lots 61.01. 61A, 61.07, 84, 85, Sheet One and Sheet Two, revised through June 29, 1992," prepared by John P. Morrison, P.L.S. and filed in the Morris County Clerk's office on September 8, 1992 as Filed Map No. 4982.
Section 2. Street dedication. The streets known as "South Gables Drive" and "Bird Song Court" as shown on the aforesaid final map are accepted by the Township for public use as public roadways with the Township to have and hold such public roadways as long as same shall be used, operated and maintained for public purposes. In the event the above-named streets are no longer used for such public purposes, they shall revert to the abutting property owners.

The said streets are shown on a certain map entitled "Final Plat of Chesterfield Farms, Chester Township, Morris County, New Jersey," prepared by Carlton Frost, Associated Consultants, dated September 1987, and filed in the Morris County Clerk's office on October 26, 1987, as Filed Map No. 4622.
Section 2. Street dedication. The streets known as "Chesterfield Drive" and "Cricket Lane" as shown on the map entitled "Final Plat of Chesterfield Farms, Chester Township, Morris County, New Jersey" are accepted by the Township for public use as public roadways, with the Township to have and hold such public roadways as long as same shall be used, operated and maintained for public purposes. In the event the above-named streets are no longer used for such public purposes, they shall revert to the abutting property owners.

Section 1. A portion of the street known as "Beacon Hill Drive" is hereby accepted by the Township of Chester ("Township") from Custom Living Homes, Inc., a corporation of the State of New Jersey. The portion of Beacon Hill Drive being accepted is from the southerly lot lines of Block 7, Lots 12.41 and 12.43, to the intersection of Fox Chase Road. The remaining portion of Beacon Hill Drive is not being accepted by the Township at this time. The portion of the said street is shown on a certain map entitled "Final Map, Beacon Hill, Section IV, Chester Township, Morris County, New Jersey," dated November 7, 1986, prepared by Robert A. Yannaccone, L.S. of Yannoccone Associates and filed in the Morris County Clerk's office on August 6, 1987, as Filed Map No. 4601.
Section 2. Street dedication. The said portion of the street known as "Beacon Hill Drive" as shown on the aforesaid final map is accepted by the Township for public use as a public roadway, with the Township to have and hold such public roadway as long as same shall be used, operated and maintained for public purposes. In the event the portion of the above-named street is no longer used for such public purposes, it shall revert to the abutting property owners.

The streets known as "Deer Hill Road" and "Pond View Road" are hereby accepted by the Township of Chester ("Township") Segal Development Associates, L.P., a limited partnership of the State of New Jersey. The said streets are shown on certain maps entitled "Final Map of The Pond at Chester, Section One, Township of Chester, Morris County, N.J., January 19, 1989," which map was filed in the Morris County Clerk's office on July 25, 1990, as Map No. 4869 and "Final Map of The Pond at Chester, Section Two, Township of Chester, Morris County, New Jersey, June, 1992" which map was filed in the Morris County Clerk's office on December 1, 1992, as Map No. 4992.
Section 2. Street dedication. The streets known as "Deer Hill Road" and "Pond View Road" as shown on the aforesaid final maps are accepted by the Township for public as public roadways, with the Township to have and hold such public roadways as long as same shall be used, operated and maintained for public purposes. In the event the above-named streets are no longer used for such public purposes, they shall revert to the abutting property owners.
Section 3. This ordinance shall take effect as provided by law.

Section 1. The streets known as "Cromwell Drive," "Topping Way" and "Woodhull Drive" are hereby accepted by the Township of Chester ("Township") from Segal & Morel Partnership, of Suite 310, 140 Littleton Road, Parsippany, New Jersey. Said streets are shown on a certain map entitled "Pleasant Hill Estates" dated June 2, 1988, prepared by Carlton N. Frost, P.E., L.S., which map was approved by a Planning Board resolution dated March 14, 1989, and amended on April 11, 1989, which map was filed in the Morris County Clerk's Office on December 8, 1989, as Map No. 4822.
Section 2. The streets known as "Cromwell Drive," "Topping Way" and "Woodhull Drive" as shown on the aforesaid filed maps are accepted by the Township for public use as public roadways as long as they shall be used, operated and maintained for public purposes. In the event that the aforesaid streets are no longer used for such public purposes, they shall revert to the abutting property owners.
Section 3. This ordinance shall take effect as provided by law.

Section 1. The following streets in the subdivision known as "Forrest Hill at Chester" located in whole or in part in Sections I, II, IIIA, IIIB, IV and V of the subdivision are accepted by the Township of Chester from Kendall Construction Corporation, a New Jersey corporation, whose principal place of business is 60 Ketcham Road, Hackettstown, New Jersey 07840:
(a) Old Farmstead Road;
(b) Green Hill Road;
(c) Wood Stone Road; and
(d) Meadowbrook Road.
Said streets are shown on the following maps filed in the Morris County Clerk's office, Morristown, New Jersey:

Section 2. The Township is accepting Wortman Way without the benefit of a deed from Joseph Supor. Mr. Supor is deceased and attempts to have his estate transfer title have been unsuccessful. Wortman Way is shown on the above referenced filed map number 5448. The Township Engineer has certified that the improvements to Wortman Way are complete.
Section 3. The street known as Wortman Way shown on the aforesaid filed map is accepted by the Township for public use as a public roadway as long as it shall be used, operated and maintained for public purposes. Section 2. The streets known as Trout Brook Court and Pine Ridge Court as shown on the aforesaid filed map are accepted by the Township for public use as a public roadway as long as it shall be used, operated and maintained for public purposes. In the event the aforesaid roads are no longer used for such public purposes, either or both shall revert to the abutting property owners.

Section 1. The Township of Chester hereby establishes and accepts the street commonly known as "Stanley Place" within the Township of Chester, County of Morris, State of New Jersey as a public road, said road being approximately 33 feet in width and beginning at the sideline of Old Chester-Gladstone Road and running west approximately 694 feet and terminating at Block 4, Lot 24, as depicted on the Tax Map of the Township of Chester at Sheet 9, revised October, 2014 by William A. DiBartolo, Jr., P.L.S., a copy of which is appended hereto as Exhibit A.
Section 2. The Township Clerk is directed to record and file this ordinance with the Morris County Clerk pursuant to N.J.S.A. 40:67-2.
Section 3. All ordinances of the Township of Chester which are inconsistent with the provisions of this ordinance, are hereby repealed to the extent of such inconsistency.
Section 4. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this ordinance.
Section 5. This ordinance shall take effect upon final passage, approval and publication as required by law.

• Ann Lane;
• Baker Road;
• Overlook Terrace;
• Mt. Paul Road;
• School House Lane;
• Valley View Road;
• Wilson Avenue;
• Jefferson Avenue;
• A portion of Mile Drive (upper and lower dog leg), Block 26.01 Lots 28, 29, 30, 31, and 32;
• A portion of Mountain View Drive Block 10.3 lots 7, 8, 18, 16, and 17; and
• Roads contained in the development known as Four Seasons: Drake Lane, Brown Court, Wyckoff Way, Young Court, and Dickerson Road.
Except for the streets and roads specifically identified herein, any other roads and streets that have not been dedicated and accepted as public streets by the Township of Chester shall not be entitled to have snow and ice removed by the Township of Chester.
Section 2. The Township of Chester will not be responsible for any other maintenance or repair for the roads noted in Section 1 above.
Section 3. Snow plow and ice removal services on the roads in Section 1, or portions thereof, may be suspended if, in the opinion of the Superintendent of Public Works, the roadway is in such condition to cause a safety hazard to municipal employees and/or municipal vehicles and equipment. The snow and ice removal services may be resumed once the roadway has been restored to an acceptable condition as determined by the Superintendent of Public Works.
Section 4. A public street or road is defined as a roadway or street having been dedicated and accepted by the Township pursuant to Chester Township Code § 153-26 et seq. A private road is any street or roadway that has not been dedicated and accepted by the Township pursuant to Chester Township Code § 153-26 et seq.
Section 5. This ordinance shall take effect upon its passage and publication according to law.

Section 1. Forest View Drive and Jason Court were previously accepted as municipal roads of the Township of Chester on November 5, 1979.
Section 2. The previous action of the Mayor and Council of the Township of Chester naming the road "Jason Court" is hereby rescinded.
Section 3. The road previously known and designated as "Jason Court" is hereby renamed and shall be known as "Forest View Drive."
Section 4. This ordinance shall take effect as provided by law.
